Lebih 90 nama bermasalah dikesan daripada 2,180 nama dalam senarai pengundi pos yang terkandung dalam daftar induk pemilih bagi kawasan parlimen Lembah Pantai, kata ahli parlimennya, Nurul Izzah Anwar.

"Kami ada 97 pengundi yang nama mereka tidak dijumpai di laman web Suruhanjaya Pilihan Raya (SPR); nampaknya mereka boleh mengundi di dua tempat. Rekod-rekod lain yang mencurigakan juga dijumpai pada daftar pemilih yang dikemaskini sehingga Jun 2011," katanya.

Pada sidang akhbar di pusat khidmat PKR di Lembah Pantai hari ini, Nurul Izzah berkata, antara penemuan yang dianggap pelik ialah nama seorang pengundi yang didaftarkan sebagai "Balai Polis Kerinchi" dalam daftar pemilih induk.

"Apabila kita semak butir-butir menggunakan nombor kad pengenalan polis bagi mengenal pasti pengundi berkenaan, nama itu wujud tetapi dalam daftar pemilih SPR ia menunjukkan sebaliknya," katanya.

Beliau berkata, nombor kad pengenalan, RF161872, pada pangkalan data SPR menunjukkan ia milik Yusop Mohd Faizul Mohd .

"Kita tidak tahu jika ia Balai bin Polis Kerinchi atau Balai Polis bin Kerinchi," sindir Nurul Izzah.

Masalah-masalah lain termasuk rekod pengundi tidak dijumpai di laman web SPR tetapi muncul dalam daftar pemilih.

"Apa yang lebih mengejutkan ialah ada pengundi yang disenaraikan di dua pusat mengundi. Sebagai contoh, Saripah Arif (RF90153), disenaraikan sebagai pengundi pos di balai polis Pantai dan juga balai polis Pekan, yang terletak di Pahang," katanya.

Pada tahun 2008 kawasan pilihan raya itu mempunyai kira-kira 56000 pengundi tetapi pada Jun tahun ini, Lembah Pantai kini mempunyai kira-kira 70,000 pengundi berdaftar.

"Kita tidak lagi boleh mempercayai sistem sekarang, apa yang akan berlaku jika pilihan raya diadakan secara tiba-tiba? Ini adalah daftar yang diwartakan bagi suku ketiga. Ini adalah senarai daftar yang kita terpaksa gunakan jika pilihan raya diadakan esok," katanya dengan nada kecewa.

Nurul Izzah sebelum ini berkata bahawa bilangan pengundi pos naik secara mendadak sebanyak 1,363 peratus dalam tempoh dua bulan - dari hanya 149 orang pada 26 Sept tahun ini kepada 2,180 pada 2 November lalu.

KUALA LUMPUR, Dec 1 — A nervous Umno has failed to bring a new ideas to voters ahead of a general election expected soon, says Dr Mohd Asri Zainul Abidin.

The maverick scholar, who has a large following here, told The Malaysian Insider the senior partner in Barisan Nasional (BN) must understand the youth do not just need material wealth but also assurances of their rights and freedom.

“The current generation is different from those in the past. They will not be attracted by just cash and handouts,” the former Perlis mufti said after attending the start of Umno’s general assembly as the party’s guest yesterday.

Asri, who is now a research fellow at the Oxford Centre for Islamic Studies, cited other Muslim countries such as Bahrain and Saudi Arabia who are “rich and have no money problems but what they need and want are

rights and freedom.”

Prime Minister Datuk Seri Najib Razak has promised a raft of reforms over the past few months but the opposition and civil society have said his “political transformation programme” has fallen short.

Although a parliamentary select committee has been meeting to discuss electoral reforms, the Peaceful Assembly Bill passed this week is said to be “even more repressive” than previous regulations while the repeal of the Internal Security Act has been delayed to March.

Umno is holding what is likely to be its last general assembly before polls expected early next year with a focus on the need to be relevant.

Party president Najib has called on Umno to be “extraordinary” to gain a strong mandate in the coming elections while his deputy Tan Sri Muhyiddin Yassin invited members to a “jihad (holy war)” in what he termed “the mother of all elections.”

But Asri, a Universiti Sains Malaysia lecturer, said Umno appears to have contracted “an anxiousness” as “most voters support the opposition not because they like the opposition but because they hate Umno.”

“Why do they hate Umno? This is a phenomenon that Umno must understand instead of attacking the opposition endlessly.

“Umno is talking among themselves. I see Umno is now anxious and has no idea what will happen in the coming elections,” he said.

Skandal NFC - Shahrizat mesti berundur

'Fakta' dari mulut MP Ampang

1. Kerajaan mungkin buat tak tahu tujuan pengeluaran (drawdown) wang pinjaman (RM250 juta)

2. Salah bagi NFC untuk beli kondominium bagi kegunaan peribadi pengarah menggunakan duit tabung rakyat.

3. Khairy kata kondominium itu pelaburan sementara menunggu pulangan dari perniagaan lembu. Tapi Zuraidah kata kalau nak melabur pun mestilah dalam lembu jugak.

4. Perbelanjaan boros bukan nya kegagalan projek yang menjadi isu.

5. NFC mesti ada 60,000 ekor lembu setiap bulan tetapi setelah beroperasi selama 3 tahun cuma ada 8,000 ekor lembu. Ini bermakna NFC cuma ada lebih kurang 3,000 ekor lembu setahun.

6. RM250 juta pinjaman mudah (soft loan) dan geran RM13 juta untuk kerja infra juga diberikan kerajaan. Tanah seluas 5,000 ekar turut diberikan kerajaan.

7. Dalam penyata kepada SSM (ROC) jelas keseluruhan RM250 juta telah dikeluarkan oleh NFC.

8. MP Kinabatangan cabar Shahrizat letak jawatan kerana memalukan kerajaan BN.

9. Wanita PKR dan wanita Pakatan akan buat protes seluruh negara minggu depan sekiranya Shahrizat tidak respon kepada desakan letak jawatan. Mereka juga akan buat laporan Polis dan laporan kepada SPRM.

10. Setakat ini tidak seorang pun kepimpinan Wanita UMNO, baik Timbalan mahupun Naib Ketua Wanita memberi sokongan kepada Shahrizat dalam hal NFC.

11. Setakat ini NFC belum membuat sebarang pembayaran balik pinjaman.

12. NFC bagi pinjaman (advance) sebanyak RM87 juta kepada restoran milik keluarga Shahrizat dan diskaun sebanyak RM3 juta bagi pembelian daging.

13. RM820,000 pula dibelanja bagi tujuan melancung.

Jika Hendak Sokong Janganlah Bersikap Double Standard

Semua pihak berdiri di sebelakang Prof Dr Aziz Bari tetapi tidak bersama nasib dua naib canselor Unisel, kenapa?

PETALING JAYA: Nampaknya isu berkaitan tindakan penggantungan tugas buat sementara waktu oleh pihak pengurusan Universiti Islam Antarabangsa (UIA), ke atas pensyarah undang-undang mereka, Prof Dr Abdul Aziz Bari telah mengundang reaksi yang merentasi pelbagai spektrum dan lapisan organisasi.

Dari persatuan kakitangan akademik universiti lain, rakan-rakan pensyarah seperti Dr Asri Zainul Abidin sehinggalah kepada pertubuhan-pertubuhan bukan kerajaan dan pertubuhan politik tidak terlepas daripada turut mengambil bahagian melontarkan kritikan dan pandangan mereka ke atas tindakan penggantungan Dr Aziz Bari itu.

Malah Dr Asri mengatakan tindakan UIAM itu sebagai sesuatu yang tidak bertamadun dan memalukan dunia akademik.

Malah kalangan pelajar UIA sendiri telah mengadakan tunjuk perasaan di luar pekarangan masjid universiti sejuru selepas solat Jumaat dengan menyatakan tidak setuju dengan tindakan yang dikenakan ke atas cikgu mereka itu.

Dari kalangan pemimpin-pemimpin parti politik pula, Setiausaha Publisiti DAP, Tony Pua, Exco Kerajaan Negeri Selangor Elizabeth Wong, Ketua Pemuda PKR, Shamsul Md Akin dan ramai lagi turut mengecam tindakan yang diambil oleh UIAM ke atas Dr Aziz Bari.

Rektor UIA Prof Datuk Dr Zaleha Kamaruddin tidak duduk diam. Beliau dengan segera pada tengah hari Jumaat memanggil satu sidang akhbar bagi membetulkan persepsi dunia luar ke atas apa yang berlaku.

Katanya, tindakan penggantungan yang dikenakan ke atas Dr Aziz Bari sebenarnya bukanlah satu bentuk hukuman tetapi ia adalah sekadar tempoh untuk memberi tunjuk sebab berhubung kenyataan Aziz berkaitan titah Sultan Selangor, Sultan SharafuddinIdris Shah baru-baru ini.

Dr Zaleha juga menjelaskan, penggantungan khidmat Abdul Aziz berkuat kuasa dari 19 sehingga 25 Oktober ini adalah merupakan penggantungan bergaji penuh.

"Penggantungan itu dibuat bagi melicin dan mempercepatkan siasatan tanpa sebarang gangguan bagi mendapatkan penjelasan daripada beliau berhubung kenyataan yang dikeluarkan itu secepat mungkin," kata Dr Zaleha sambil menegaskan tindakan yang dibuat ketika ini (penggantungan dan penyiasatan) adalah urusan UIA dan tidak mahu campur tangan pihak luar.

Dr Zaleha juga menjelaskan, Peraturan Tatatertib UIA tidak menetapkan apa-apatempoh untuk penggantungan “tetapi apabila beliau (Dr Aziz) sudah menjawab surat tunjuk sebab itu, barulah kita akan memastikan sama ada wujud atau tidak alasan-alasan untuk meneruskan tindakan tatatertib kepada beliau.” (sekiranya ada).

"Peraturan 15 dalam Peraturan Tatatertib Kakitangan UIA memperjelaskanbahawa kebebasan ahli akademik membuat sebarang kenyataan umumhendaklah tidak bercanggah dengan kepentingan universiti," katanya.

Beliau menambah, siasatan dan surat tunjuk sebab Abdul Aziz selepasitu akan diperbincangkan dalam Tribunal Universiti.

Jadi kesimpulannya ialah, sementara pihak- pihak tertentu apatah lagi golongan akademik menegaskan bahawa ahli akademik atas sifat semulajadi kerjaya mereka harus dan wajar diberi ruang untuk menyatakan pendapat dan pandangan tetapi pada masa yang sama, pihak pengurusan UIAM berpendapat apa juga tindak-tanduk kakitangan mereka sama ada dari segi pendapat dan juga perbuatan sementara dibenarkan berbuat demikian pada masa yang sama adalah juga tertakluk kepada peraturan dan aspirasi universiti.

Pandangan ini juga sebenarnya tidak salah. Dalam mana-mana pertubuhan pun sama ada politik , bukan politik, kebajikan mahupun kesukarelawan, tetap ada peraturan dan undang-undang lebih-lebih lagi jika sesuatu perbuatan yang dilakukan itu dilihat bercanggah dengan kepentingan badan itu sendiri.

Dan inilah yang berlaku kepada Universiti Selangor (Unisel) pada tahun 2008 dan kemudiannya sekali lagi pada Ogos tahun ini apabila naib canselornya ditamatkan perkhidmatan (tanpa dinyatakan sebab) dan seorang lagi meletakkan jawatan, khabarnya akibat tekanan politik.

Walaupun pemecatan dan peletakan jawatan mereka tidak jelas dan samar-samar tetapi tindak tanduk mereka dilihat oleh pihak pentadbiran dan pemilik sebagai tidak selari dengan aspirasi universiti itu.

Dalam kes pertama yang berlaku pada Jun 2008, Prof Datuk Dr Mohd Razali Agus telah ditamatkan perkhidmatannya selaku naib canselor oleh Menteri Besar Selangor Tan Sri Khalid Ibrahim yang juga pengerusi Pendidikan Industri Yayasan Selangor Sdn Bhd iaitu pemilik dan pentadbir Unisel tanpa menyatakan sebarang sebab.

“Surat itu (penamatan khidmat) tiada kepala surat (letter head) kerajaan negeri tetapi ia datang daripada menteri besar Selangor menamatkan perkhidmatan saya dengan memberi notis sebulan. Surat itu juga tidak dinyatakan sebarang alasan berhubung penamatan perkhidmatan saya,” kata Prof Dr Razali Agus.

Tan Sri Khalid Ibrahim

Dalam kes yang kedua pula, Datuk Dr Rosti Saruwono terpaksa melepaskan jawatannya setelah dikatakan menerima tekanan politik daripada kerajaan negeri dan juga pihak dalam Unisel setelah beliau tidak bersetuju dengan surat yang beliau terima daripada pejabat menteri besar memintanya supaya menamatkan perkhidmatan tiga pegawai Unisel tanpa melalui proses tatatertib dan juga peraturan dalaman.

Yang menghairankan, dalam kedua-dua kes melibatkan bekas naib canselor Unisel itu dan juga tiga kakitangan Unisel yang diarahkan dipecat tanpa melalui proses tunjuk sebab atau perbicaraan dalaman, tidak ada pula tunjuk perasaan atau kenyataan protes atau kritikan daripada parti-parti politik sama ada DAP, PKR mahupun PAS.

Tidak ada suara-suara yang mengatakan telah berlaku atau wujud campur tangan politik atau kerajaan negeri dalam urusan akademik di Unisel itu.

Naib-naib canselor dan kakitangan Unisel seolah-olah seperti keseorangan di dalam menghadapi tindakan daripada pihak atasan. Apakah ini kerana yang mengambil tindakan atau yang memberi arahan supaya tindakan diambil adalah menteri besar dari sebuah kerajaan yang didokong oleh DAP, PKR dan PAS?

Tetapi dalam kes Dr Aziz Bari ini pula, apakah beliau mendapat sokongan daripada DAP, PKR dan PAS kerana pensyarah itu sering kali memberi kenyataan atau pandangan yang cenderung menyebelahi mereka?

Tidak salah dan tidak apa jika hendak memihak kerana ia adalah hak demokrasi sesiapa sahaja tetapi jika hendak bermain di gelanggang yang adil sepertimana yang sering dilaung-laungkan oleh mereka yang menyokong Dr Aziz Bari maka eloklah juga sokongan yang sama turut diberikan kepada bekas-bekas naib canselor dan pensyarah Unisel yang ditamatkan perkhidmatan, diberi tekanan supaya melepaskan jawatan dan diarahkan supaya dipecat tanpa melalui proses sepertimana yang sedang dilalui oleh Aziz Bari sekarang.

Jika ini dapat dilakukan barulah adil namanya. Sekurang-kurangnya dalam kes Dr Aziz Bari, beliau diberi peluang untuk menjawab surat tunjuk sebab dan bukannya terus dipecat, ditamatkan perkhidmatan atau dilucutkan jawatan sepertimana yang terjadi di Unisel.

Di sebalik segala kecaman yang dilemparkan ke atas UIAM, mereka telah membuktikan bahawa mereka tidaklah sekejam Unisel yang dibawah pentadbiran Kerajaan Negeri Selangor.

Malah UIAM selaku majikan berhak memberikan surat tunjuk sebab (bukannya surat pemecatan atau tamat perkhidmatan) ke atas mana-mana kakitangannya jika mereka merasakan tindak tanduk kakitangan tersebut bercanggah dengan aspirasi universiti itu sendiri.

Mana-mana pekerja pun tidak kira apa taraf kedudukkannya tidak terlepas daripada tertakluk kepada peraturan dan prosedur operasi standard. Jika rasa tidak mahu terikat dengan apa-apa peraturan dan prosedur, adalah wajar dan lebih baik tidak bernaung di bawah mana-mana panji mahupun organisasi.

Jadilah seperti Sasterawan Negara, A. Samad Said - bebas ke mana-mana, bebas menyatakan pandangan dan pendapat dan bebas naik ke pentas apa juga yang dirasakan serasi dan sesuai dengan jiwa dan hati nuraninya kerana beliau tidak terikat dengan mana-mana majikan dalam dunia ini.

An agreement forged and forgotten

The 18-points Agreement signed on July 9, 1963 before the formation of Malaysia is an important document safeguarding the rights and autonomy of Sarawak and Sarawakians. So why don’t we know it?

NOT many Sarawakians are well-versed in the 18-points Agreement and only some have heard some aspects if not all of the salient points representatives of Sarawak laid out prior to the formation of Malaysia.

A survey held by The Borneo Post, however, discovered that people are not only unsure of its contents, many did not even know what it was. One answer to the query about their opinion of the 18 points Agreement was this: “18-points?

Is that a hole on the golfing green?”

Contrary to some opinions, ignorance is not bliss. Without any knowledge of our rights as Sarawakians, what do we know of our place within the federation of Malaysia?

A little history

The 20/18-points Agreement or memorandum were the conditions laid out by Sabah and Sarawak respectively before agreeing to form the Federation of Malaysia with the Federation of Malaya and Singapore.

The agreements, which can be found in the Proclamation of Malaysia and also the Cobbold Commission reports, stated the conditions and rights that were meant to safeguard the autonomy and the special interest of the people of Sabah and Sarawak, protecting, among others, these regions’ rights on religion, language, education, administration, economy and culture.

Some of the points were incorporated into the Constitution of Malaysia while the rest of Sarawak’s 18 points are outlined as follows: Point

“The decision to accept the proposal by Tunku Abdul Rahman to become part of the federation of Malaysia was made by the people of Sabah and Sarawak on the understanding that the special interests of the state would be safeguarded. The interests of the two states were enshrined in the 20/18 Point Agreement.

Our rights were also inscribed in the London Agreements and Inter-Governmental Committee Reports.

When we agreed to form Malaysia together with North Borneo (Sabah), Singapore and Malaya 48 years ago, it was with the understanding that the safeguards were to be honoured and not taken away according to the whims and fancies of the federal government.

Based on the recommendations of the Cobbold Commission, Sabah and Sarawak would become equal partners of the state of the Federation of Malaya; not as one of the component states as stipulated in the original Article 1 of the Federal Constitution.

In other words, Sabah and Sarawak are partners of Malaysia, thus having a greater degree of fi nancial and political autonomy as compared to other sates in the Peninsula.

Sabah and Sarawak should not end up being merely one of the 13 states in Malaysia.

Therefore, it is paramount for the federal government to adhere to covenants for the purpose of safeguarding the interests, rights and autonomy of the people in Sabah and Sarawak.

The 20/18-point agreement should not be ignored or eroded.

Thus, certain policies and the relationships between Peninsular Malaysia, Sabah and Sarawak must be re-looked to address whatever imbalance in terms of infrastructure, social, economic or educational developments between the centre and periphery in the last 48 years.

More financial allocations should be channelled to Sabah and Sarawak.

The federal government should increase the petroleum royalty to at least 15 per cent from the current 5 per cent.

Therefore, the spirit of the 20/18-point agreement should be safeguarded and honoured for the interest of our future generations and more importantly to ensure a progressive, united and harmonious multi-racial nation.

Malaysia as a nation was formed of equal partners; Sabah and Sarawak did not join Malaysia. Together with Sabah, Malaya and Singapore, Sarawak formed Malaysia.

By implication, we are equal under the constitution. Our political leaders should understand, respect and honour the agreement.

“Let’s run through this love story – a handsome young man called Malaya had just held a lavish ‘coming-of-age’ birthday party on Aug 31 1957.

On the other side of the South China Sea, a beautiful young maiden called Sarawak celebrated her birthday on July 22, 1963.

This young man courted and subsequently won the heart of Sarawak and both were married on September 16th 1963 in a low-key ceremony and both took the common family name of Malaysia.

As in any marriage, vows and promises were exchanged and this lady was assured of her rights under a pre-nuptial document known as the 18-points Agreement.

The husband continued to celebrate his birthday lavishly every August 31 while the wife’s birthday was conveniently forgotten.

One fine day, the dutiful wife gently reminded the husband that August 31 was his birthday while September 16 was actually their wedding anniversary – she politely chose not to mention her own birthday or the broken promises and vows.

And with that, the couple celebrated their wedding anniversary and named it Malaysia Day.

But the wife was still hurt by the lack of attention and broken promises from the husband, though she continued to be the dutiful and responsible wife.

I believe it was with noble intentions that our leaders made that fateful decision on our behalf to enter into the Federation of Malaysia.

These intentions were reinforced with the incorporation of the 18- points Agreement to safeguard the rights and autonomy of our state, notwithstanding the benefits of joining the Federation.

These 18-points took into account our ‘uniqueness’ in terms of demographics, culture, racial composition, religious diversities as well as our ‘less-developed’ status as compared to our counterparts in Malaya and Singapore, at that critical point of time.

We were also assured of autonomy in the administration of land and immigration matters.

Education, extended usage of English and the ‘Borneanisation of the Civil service’ were also mentioned.

Moreover, we were also assured of ‘special rights and privileges’ for our natives as enjoyed by their counterparts in Malaya – ‘guaranteed’ would be a more appropriate word.

It was also mentioned that our Head of State would not be eligible to become the Agung and secession from the Federation is not an option.

However, over the years, it appeared that these 18-points were often not honoured or were slowly eroded, with justifications for better political, economic, social and administrative ‘uniformity.’

While the state may need to give way to facilitate a smoother implementation of policies in areas like education and development, many Sarawakians begin to feel that the state is giving too much and receiving too little in return.

Common grouses take the form of our relatively poorer basic infrastructures like roads, electricity and public transport.

There are also the issues of lesser opportunities in the civil service where senior positions are usually held by West Malaysians, running contrary to the ‘Borneonisation’ of the Civil service as spelt out in the 18-points Agreement.

Of late, even the ‘sensitive’ issues of race and religion have been hogging the headlines for all the wrong reasons.

May this celebration of Malaysia Day lead to greater peace and harmony among Malaysians from all walks of life and May our leaders renew the vows and promises made on that fateful day of Sept 16 1963 – Malaysia, truly Asia, unity in diversity.

“I remember Point 1 although some people still refuse to accept it because it states that Sarawak has no official religion.

It is good because we have freedom of religion in the state especially in a multi-ethnic and multi-racial society in Sarawak.

Another one I remember is Point 2 in that English is the official language in Borneo. It should be after all we were under the Rajah Brooke and also the British.

They took so much from us and I do not see why they cannot leave their language as a legacy for all Sarawakians. In fact, we should use it apart from our mother tongues all the time officially and unofficially since we are living in a border less world.

Doesn’t that count?

Every Sarawakian should read the memorandum.

Yes, we are free from the British colony, but to date, there is so much more that needs to be done. We hope to get our fair share in the future and that my generation will see a better Sarawak and fair Malaysia.

Happy Malaysia Day to all in truly Malaysian spirit.

“The 18-points Agreement made between Sarawak and Malaya during the formation of Malaysia is crucial to Sarawak’s standing in the country as a whole, and to the preservation of the identity of the state.

Point 2(c.) States that English should be one of the official languages of the state indefinitely, which I agree wholeheartedly with since English is an international language.

I also believe that Point 11, which states that Sarawak should retain control of its own finance, development and tariff, is crucial to the state as it gives us a certain degree of autonomy over our own finances and economy.

Point 16 of the 18 Points Agreement touches on Constitutional safeguards for the Sarawak State Constitution, which is the foundation of any legislation passed in the state.

The point states that no amendment, modification or withdrawal of any special safeguard granted to Sarawak should be made by the federal government without the consent and approval from the state itself.

Coupled with Point 17, which guarantees Sarawakians representation in federal parliament, it ensures that the wants and needs of Sarawakians will not only be heard, but also be processed and executed via the proper legal and executive channels.

In short, I believe that the federal government should honour the 18-points Agreement with Sarawak, for as long as Sarawak remains in the Federation.

I would also like to express my hope that all current and future Sarawakian state assembly and Parliament members will always carry out their duty entrusted to them by the people of Sarawak and protect the 18-points Agreement.”

“The way Malayans treat us, I believe gives us all reason to get out of Malaysia.

But at this stage I think it is not possible. The Malayans have been violating our 18-points Agreement, particularly points 2, 12 and 15.

Point 12 says special rights are to be accorded to the natives of Sarawak on par with those enjoyed by Malays in Malaya.

How many Dayak/Ibans are successful in business, education, or in the top government position?

We are still lagging behind compared to West Malaysia and we are still developing our urban and rural areas.

People in the city are fi ne but those in the rural areas still lack basic infrastructure like water, road and electricity.

We are considered a developed nation but we still live in undeveloped conditions.

The 18 points is our right and something has to be done about it.

Luckily we have autonomy on immigration or else it would have opened the floodgates for others from other state to take what is ours, especially in the economic and business aspect.

I like it to remain our status quo and should stay under the state control because that was part of the agreement.

It should be exercised purely to safeguard the interest of the Sarawakian people at large.

However, Sarawak and Malaysia as a whole is a peaceful nation and I hope that our leaders do something more positive on the 18 points so that our interest will continue to safeguarded.

Sept 16 1963 was a historic moment and let us celebrate this Malaysia Day 2011 with hope and optimism.”

Dua warga Nigeria dan wanita tempatan dituduh tipu guru RM46,000

MELAKA: Dua lelaki warga negara Nigeria dan seorang wanita rakyat tempatan dihadapkan di Mahkamah Sesyen di sini kerana dituduh menipu seorang guru RM146,600 dengan menawarkan kertas hitam yang kononnya boleh ditukar menjadi dolar Amerika Syarikat dengan menggunakan sejenis cecair kimia.

Obi Uzoma, 28; Nwabudike Emmanual Chukwuma, 28, dan Azlinda Hussain, 38, didakwa bersama-bersama dua lagi yang masih bebas melakukan kesalahan itu di Public Bank cawangan Masjid Tanah dan CIMB Bank cawangan Masjid Tanah dekat sini pada 29 Jun lalu.

Mereka dituduh menipu Mashitoh Hassan, 36, dengan menawarkan kertas hitam yang boleh ditukar kepada wang dolar Amerika Syarikat dengan cara menggunakan sejenis cecair kimia sehingga Mashitoh percaya dan mendorong beliau memasukkan wang berjumlah RM53,600 ke akaun CIMB Bank dan RM93,000 ke akaun Public Bank milik Azlinda bagi membeli cecair kimia itu.

Pertuduhan adalah mengikut Seksyen 420 Kanun Keseksaan dan dibaca bersama Seksyen 34 Kanun yang sama, yang membawa hukuman penjara tidak kurang satu tahun dan maksimum 10 tahun serta sebatan dan boleh juga dikenakan denda.

Kesemua tertuduh yang tidak diwakili peguam mengaku tidak bersalah dan minta dibicarakan.

Dua warga negara Nigeria itu memasuki negara ini menggunakan pas pelajar sejak tiga tahun lalu manakala Azlinda dari Bandar Baru Bangi adalah kerani di sebuah kedai tayar.

Hakim Zaharah Hussain menetapkan 6 Oktober ini untuk sebutan semula kes dan membenarkan Azlinda diikat jamin sebanyak RM20,000 dengan dua orang penjamin serta melaporkan diri di balai polis berdekatan pada setiap bulan.
Beliau tidak membenarkan dua warga Nigeria itu diikat jamin selepas mendengar permohonan Timbalan Pendakwa Raya, Mahadi Abdul Jumaat, yang bimbang mereka akan melarikan diri dari Malaysia. - BERNAMA

IN ASHES: A squatter village near Kampung Baru in Kuala Lumpur lie in ruins on May 14, 1969

THE violence that erupted in Kuala Lumpur on May 13, 1969, and the happenings on that day are a blot on the history of Malaysia.

Prior to that, the country's progress to independence, the transition to power and of the evolution of an independent national spirit, all these phases in the history of our people had been by and large peaceful in character.

The tragedy of May 13 was so serious the Federal government had to take drastic actions which led to the breakdown of the Constitution as the whole of the legislative structure of the Constitution was virtually suspended. Maybe, at this juncture, it is appropriate to trace the events leading to the tragic day.

It began when Parliament was dissolved on March 20, 1969, and a general election for the Dewan Rakyat and all State Legislative Assembl ies was starting on Saturday, May 10. Vigorous campaigning by politicians took place and feelings became inflamed, culminating in inter-racial rioting beginning on Tuesday, May 13, in Kuala Lumpur.

It temporarily disrupted the machinery of the Federal government, but fortunately the rioting was quickly contained. We can speculate the reasons for the rioting.

It can be said that the reasons were many, revolving around political, social and economic issues.

Two days after the outbreak of violence, the Yang di — Pertuan Agong proclaimed a state of emergency under Article 150 of the Constitution. At the same time, acting under clause (2) of the Article, he promulgated the Emergency (Essential Powers) Ordinance No. 1, 1969, giving himself wide powers for securing public safety, the defence of Malaysia, the maintenance of public order and of supplies and services essential to the life of the community. All elections that had not been completed were suspended.

Then the King promulgated a second Ordinance delegating the executive authority of the Federation to a Director of Operations (Tun Abdul Razak Hussein, then Deputy Prime Minister) who was also appointed by the King. The Director of Operations was given wide powers and was assisted by a National Operations Council (NOC).

During emergency, there was established a National Consultative Council (NCC) consisting of members of all races and all political parties except one whose leaders refused an invitation from the government to serve.

The NCC discussed privately the causes of the riots and arrived at certain conclusions. The most important outcome of their discussions was amendment to the constitution effected by the Constitution (Amendment) Act, 1971, assented to on and effective from March 10, 1971, which had been passed by the necessary two-thirds majority though the government did not have a two-thirds majority in the lower House. Some Opposition members voted with the government in the national interest.

The amendment makes it sedition or (if Parliament makes law to that effect) a crime if anyone were to question the rights and privileges established or protected by those provisions of the Constitution relating to citizenship (Part III), to the national language and the use of other languages for non-official purposes (Article 152), to quotas for Malays and natives of Borneo, and to the protection of the legitimate interests of other communities (Article 150) and to the sovereignty of the Rulers (Article 181) though there is no bar to anybody questioning implementation of those provisions.

Even in Parliament and in State Legislative Assemblies, it is now forbidden to question these rights and privileges (Sedition Act 1948).

They are commonly referred to as "sensitive issues".

Many emergency Ordinances and Regulations were passed by the NOC for the purpose of restoring law and order and also for instituting measures relating to social and economic issues.

With the tragedy of May 13 fresh in the minds of the people, with so many dead and with the disruptions and dislocations it caused, the NOC under Abdul Razak realised the achievement of national unity and racial economic integration was the most critical problem confronting the country. The political leadership was of the view that a new course had to be charted to forge a cohesive and united Malaysian nation which would be based on equal justice and fairer share of the fruits of economic development for Malaysians, irrespective of race or origins.

Only then, it was thought, would it be possible to avoid another similar tragedy and to establish lasting political stability. Towards this end, the national ideology of Rukun Negara was proclaimed to the nation on the anniversary of Independence Day in 1970.

The Rukun Negara reads as follows: "Our nation Malaysia being dedicated to achieving a greater unity of her people; to maintaining a democratic way of life; to creating a just society in which the wealth of the nation shall be equitably shared; to ensuring a liberal approach to her rich and diverse cultural traditions; to building a progressive society which shall be oriented to modern science and technology; We hear peoples pledge our united efforts to attain these ends guided by these five principles:
• Belief in God.
• Loyalty to King and Country.
• Upholding the Constitution.
• Rule of Law.
• Good Behaviour and Morality.

The political statesmanship and foresight of this approach to nationbuilding by means of consensus instead of confrontation and through frank but closed-door discussions of sensitive national issues, has been demonstrated by the uninterrupted political stability of the country since 1969. Rukun Negara represents a passport towards achievement of not merely the co-existence of the various races but the inter-mingling of the
various races in this country harmoniously.

The government also took steps to implement plans to provide for a more just and equitable society in the country. The New Economic Policy (NEP) was formulated as the economic foundation of the Rukun Negara.

Abdul Razak, in his wisdom, was fully aware that, important though the ideas of Rukun Negara and consensus building might be, the battle for unity would be worn or lost in the economic and social restructuring of the nation.

The NEP was therefore designed with the intention of giving content and substance to the new Malaysian ideology of nation-building as embodied by the Rukun Negara.

Beginning with the Second Malaysia Plan as the first phase, the NEP was launched with the hope that a new Malaysian society would gradually emerge with a common value system transcending ethnic, cultural and social-economic differences.

A two-pronged strategy was adopted toreduce and eventually eradicate poverty by raising income levels and increasing employment opportunities for all Malaysians irrespective of race; and accelerate the process of restructuring Malaysian society to correct economic imbalances so as to reduce and eventually eliminate the identification of race with economic function.

This process of restructuring society involved the modernisation of rural life, a rapid and balanced growth of urban activities and the creation of a viable Bumiputra commercial and industrial community in all categories of enterprises and at all levels of operation so that they will become real and effective partners in all aspects of the economic life of the nation.

Now, of course, there is a need to examine as to whether or not the objectives of the NEP have been achieved. Whatever the case may be, everyone must not lose sight of the main national objective of enabling the Malays and the natives of Sabah and Sarawak to be eventually integrated into the economic mainstream.

It appears that lately the government has been focusing on efforts to fight corruption and therefore in my next article, I shall highlightcorruption issues and offer some solutions for consideration by those concerned.

"Mana Mak?'

Jam 6.30 petang.
Mak berdiri di depan pintu. Wajah Mak kelihatan resah. Mak tunggu adik bungsu balik dari sekolah agama.

Ayah baru balik dari sawah.
Ayah tanya Mak, "Along mana?'

Mak jawab, "Ada di dapur tolong siapkan makan."

Ayah tanya Mak lagi," Angah mana?"

Mak jawab, "Angah mandi, baru balik main bola."

Ayah tanya Mak, "Ateh mana?"

Mak jawab, "Ateh, Kak Cik tengok tv dengan Alang di dalam?"

Ayah tanya lagi, "Adik dah balik?"

Mak jawab, "Belum. Patutnya dah balik. Basikal adik rosak kot. Kejap lagi kalau tak balik juga jom kita pergi cari Adik."

Mak jawab soalan ayah penuh yakin. Tiap-tiap hari ayah tanya soalan yang sama. Mak jawab penuh perhatian. Mak ambil berat di mana anak-anak Mak dan bagaimana keadaan anak-anak Mak setiap masa dan setiap ketika.

Dua puluh tahun kemudian

Jam 6.30 petang

Ayah balik ke rumah. Baju ayah basah. Hujan turun sejak tengahari.

Ayah tanya Along, "Mana Mak?"

Along sedang membelek-belek baju barunya. Along jawab, "Tak tahu."

Ayah tanya Angah, "Mana Mak?"

Angah menonton tv. Angah jawab, "Mana Angah tahu."

Ayah tanya Ateh, "Mana Mak?"

Ayah menunggu lama jawapan dari Ateh yang asyik membaca majalah.
Ayah tanya Ateh lagi, "Mana Mak?"
Ateh menjawab, "Entah."
Ateh terus membaca majalah tanpa menoleh kepada Ayah.

Ayah tanya Alang, "Mana Mak?"

Alang tidak jawab. Alang hanya mengoncang bahu tanda tidak tahu.

Ayah tidak mahu tanya Kak Cik dan Adik yang sedang melayan facebook. Ayah tahu yang Ayah tidak akan dapat jawapan yang ayah mahu.

Tidak ada siapa tahu di mana Mak. Tidak ada siapa merasa ingin tahu di mana Mak. Mata dan hati anak-anak Mak tidak pada Mak. Hanya mata dan hati Ayah yang mencari-cari di mana Mak.

Tidak ada anak-anak Mak yang tahu setiap kali ayah bertanya, "Mana Mak?"

Tiba-tiba adik bungsu bersuara, "Mak ni dah senja-senja pun merayap lagi. Tak reti nak balik!!"

Tersentap hati Ayah mendengar kata-kata Adik.

Dulu anak-anak Mak akan berlari mendakap Mak apabila balik dari sekolah. Mereka akan tanya "Mana Mak?" apabila Mak tidak menunggu mereka di depan pintu.

Mereka akan tanya, "Mana Mak." Apabila dapat nomor 1 atau kaki melecet main bola di padang sekolah. Mak resah apabila anak-anak Mak lambat balik. Mak mahu tahu di mana semua anak-anaknya berada setiap waktu dan setiap ketika.

Sekarang anak-anak sudah besar. Sudah lama anak-anak Mak tidak bertanya 'Mana Mak?"

Semakin anak-anak Mak besar, soalan "Mana Mak?" semakin hilang dari bibir anak-anak Mak .

Ayah berdiri di depan pintu menunggu Mak. Ayah resah menunggu Mak kerana sudah senja sebegini Mak masih belum balik. Ayah risau kerana sejak akhir-akhir ini Mak selalu mengadu sakit lutut.

Dari jauh kelihatan sosok Mak berjalan memakai payung yang sudah uzur. Besi-besi payung tercacak keluar dari kainnya. Hujan masih belum berhenti. Mak menjinjit dua bungkusan plastik. Sudah kebiasaan bagi Mak, Mak akan bawa sesuatu untuk anak-anak Mak apabila pulang dari berjalan.

Sampai di halaman rumah Mak berhenti di depan deretan kereta anak-anak Mak. Mak buangkan daun-daun yang mengotori kereta anak-anak Mak. Mak usap bahagian depan kereta Ateh perlahan-lahan. Mak rasakan seperti mengusap kepala Ateh waktu Ateh kecil. Mak senyum. Kedua bibir Mak diketap repat. Senyum tertahan, hanya Ayah yang faham. Sekarang Mak tidak dapat lagi merasa mengusap kepala anak-anak seperti masa anak-anak Mak kecil dulu. Mereka sudah besar. Mak takut anak Mak akan menepis tangan Mak kalau Mak lakukannya.

Lima buah kereta milik anak-anak Mak berdiri megah. Kereta Ateh paling gah. Mak tidak tahu pun apa kehebatan kereta Ateh itu. Mak cuma suka warnanya. Kereta warna merah bata, warna kesukaan Mak. Mak belum merasa naik kereta anak Mak yang ini.

Baju mak basah kena hujan. Ayah tutupkan payung mak. Mak bagi salam. Salam Mak tidak berjawab. Terketar-ketar lutut Mak melangkah anak tangga. Ayah pimpin Mak masuk ke rumah. Lutut Mak sakit lagi.

Mak letakkan bungkusan di atas meja. Sebungkus rebung dan sebungkus kueh koci pemberian Mak Uda untuk anak-anak Mak. Mak Uda tahu anak-anak Mak suka makan kueh koci dan Mak malu untuk meminta untuk bawa balik. Namun raut wajah Mak sudah cukup membuat Mak Uda faham.

Semasa menerima bungkusan kueh koci dari Mak Uda tadi, Mak sempat berkata kepada Mak Uda, "Wah berebutlah budak-budak tu nanti nampak kueh koci kamu ni."

Sekurang-kurangnya itulah bayangan Mak. Mak bayangkan anak-anak Mak sedang gembira menikmati kueh koci sebagimana masa anak-anak Mak kecil dulu. Mereka berebut dan Mak jadi hakim pembuat keputusan muktamat. Sering kali Mak akan beri bahagian Mak supaya anak-anak Mak puas makan. Bayangan itu sering singgah di kepala Mak.

Ayah suruh Mak tukar baju yang basah itu. Mak akur.

Selepas Mak tukar baju, Ayah iring Mak ke dapur. Mak ajak anak-anak Mak makan kueh koci. Tidak seorang pun yang menoleh kepada Mak. Mata dan hati anak-anak Mak sudah bukan pada Mak lagi.

Mak hanya tunduk, akur dengan keadaan.

Ayah tahu Mak sudah tidak boleh mengharapkan anak-anak melompat-lompat gembira dan berlari mendakapnya seperti dulu.

Ayah temankan Mak makan. Mak menyuap nasi perlahan-lahan, masih mengharapkan anak-anak Mak akan makan bersama. Setiap hari Mak berharap begitu. Hanya Ayah yang duduk bersama Mak di meja makan setiap malam.

Ayah tahu Mak penat sebab berjalan jauh. Siang tadi Mak pergi ke rumah Mak Uda di kampung seberang untuk mencari rebung. Mak hendak masak rebung masak lemak cili api dengan ikan masin kesukaan anak-anak Mak.
Ayah tanya Mak kenapa Mak tidak telepon suruh anak-anak jemput. Mak jawab, "Saya dah suruh Uda telepon budak-budak ni tadi. Tapi Uda kata semua tak berangkat."

Mak minta Mak Uda telepon anak-anak yang Mak tidak boleh berjalan balik sebab hujan. Lutut Mak akan sakit kalau sejuk. Ada sedikit harapan di hati Mak agar salah seorang anak Mak akan menjemput Mak dengan kereta. Mak teringin kalau Ateh yang datang menjemput Mak dengan kereta barunya. Tidak ada siapa yang datang jemput Mak.

Mak tahu anak-anak mak tidak sedar telepon berbunyi. Mak ingat kata-kata ayah, "Kita tak usah susahkan anak-anak. Selagi kita mampu kita buat saja sendiri apa-apa pun. Mereka ada kehidupan masing-masing. Tak payah sedih-sedih. Maafkan sajalah anak-anak kita. Tak apalah kalau tak merasa menaiki kereta mereka sekarang. Nanti kalau kita mati kita masih ada peluang merasa anak-anak mengangkat kita kat bahu mereka."

Mak faham buah hati Mak semua sudah besar. Along dan Angah sudah beristeri. Ateh, Alang, Kak Cik dan Adik masing-masing sudah punya buah hati sendiri yang sudah mengambil tempat Mak di hati anak-anak Mak.

Pada suapan terakhir, setitik air mata Mak jatuh ke pinggan.

Kueh koci masih belum diusik oleh anak-anak Mak.

Beberapa tahun kemudian

Mak Uda tanya Along, Angah, Ateh, Alang, Kak Cik dan Adik, "Mana mak?".

Hanya Adik yang jawab, "Mak dah tak ada."
Along, Angah, Ateh, Alang, Kak Cik dan Adik tidak sempat melihat Mak waktu Mak sakit.

Kini Mak sudah berada di sisi Tuhannya bukan di sisi anak-anak Mak lagi.

Dalam isakan tangis, Along, Angah, Ateh, Alang, Kak Cik dan Adik menerpa kubur Mak. Hanya batu nisan yang berdiri terpacak. Batu nisan Mak tidak boleh bersuara. Batu nisan tidak ada tangan macam tangan Mak yang selalu memeluk erat anak-anaknya apabila anak-anak datang menerpa Mak semasa anak-anak Mak kecil dulu.

Mak pergi semasa Along, Angah, Ateh, Alang, Kak Cik dan Adik berada jauh di bandar. Kata Along, Angah, Ateh, Alang, Kak Cik dan Adik mereka tidak dengar handphone berbunyi semasa ayah telepon untuk beritahu mak sakit tenat.

Mak faham, mata dan telinga anak-anak Mak adalah untuk orang lain bukan untuk Mak.

Hati anak-anak Mak bukan milik Mak lagi. Hanya hati Mak yang tidak pernah diberikan kepada sesiapa, hanya untuk anak-anak Mak..
Mak tidak sempat merasa diangkat di atas bahu anak-anak Mak. Hanya bahu ayah yang sempat mengangkat jenazah Mak dalam hujan renyai.

Ayah sedih sebab tiada lagi suara Mak yang akan menjawab soalan Ayah,

"Mana Along?" , "Mana Angah?", "Mana Ateh?", "Mana Alang?", "Mana Kak Cik?" atau "Mana Adik?". Hanya Mak saja yang rajin menjawab soalan ayah itu dan jawapan Mak memang tidak pernah silap. Mak sentiasa yakin dengan jawapannya sebab mak ambil tahu di mana anak-anaknya berada pada setiap waktu dan setiap ketika. Anak-anak Mak sentiasa di hati Mak tetapi hati anak-anak Mak ada orang lain yang mengisinya.

Ayah sedih. Di tepi kubur Mak, Ayah bermonolog sendiri, "Mulai hari ini tidak perlu bertanya lagi kepada Along, Angah, Ateh, Alang, Kak Cik dan Adik , "Mana mak?" "

Kereta merah Ateh bergerak perlahan membawa Ayah pulang. Along, Angah, Alang dan Adik mengikut dari belakang. Hati ayah hancur teringat hajat Mak untuk naik kereta merah Ateh tidak kesampaian. Ayah terbayang kata-kata Mak malam itu, "Cantiknya kereta Ateh, kan Bang? Besok-besok Ateh bawalah kita jalan-jalan kat Kuala Lumpur tu. Saya akan buat kueh koci buat bekal."

"Ayah, ayah....bangun." Suara Ateh memanggil ayah. Ayah pengsan sewaktu turun dari kereta Ateh..

Terketar-ketar ayah bersuara, "Mana Mak?"

Ayah tidak mampu berhenti menanya soalan itu. Sudah 10 tahun Mak pergi namun soalan "Mana Mak?" masih sering keluar dari mulut Ayah sehingga ke akhir usia.

Sebuah cerita pendek buat tatapan anak-anak yang kadang-kadang lupa perasaan ibu. Kata orang hidup seorang ibu waktu muda dilambung resah, apabila tua dilambung rasa. Kata Rasulullah saw. ibu 3 kali lebih utama dari ayah. Bayangkanlah berapa kali ibu lebih utama dari isteri, pekerjaan dan anak-anak sebenarnya. Solat sunat pun Allah suruh berhenti apabila ibu memanggil. Berapa kerapkah kita membiarkan deringan telepon panggilan dari ibu tanpa berjawab?

Jais acting like Gestapo

It is the tradition that a religious building is open to everyone who wishes to pray, to seek advice or just to seek solace and respite. There is no compulsion for a person to enter or to leave. <Betul tetapi jika ada mslihat lain bagaimana?>

So why was Jais so steamed up as to gate crash a social gathering in Damansara Utara Methodist Church, just because a few Muslims were present and having a conversation with other friends?< Mana ada gate crash !!! DAP putar belit>

Jais inspectors could have joined the gathering and participated in the discussions to find out what was is going on. they could have left quietly if satisfied it was a social gathering, and not a meeting to preach to Muslims to convert them to a different faith. < sekali layari screwkuat dan kita tahu apa yang mereka lakukan!!!>

So what was all the drama, action and fuss about? Why is there a phobia of Malay Muslims opting out of Islam? Misi baru Rexy

REXY Mainaky berjanji akan menamatkan kemelut menyelubungi persembahan Koo Kien Keat-Tan Boon Heong daripada berpanjangan dengan memberi fokus untuk menyiapkan mereka bagi menghadapi Sukan Olimpik, tahun depan.

Kegagalan Kien Keat-Boon Heong yang muncul naib juara di Paris tahun lalu, di suku akhir Kejohanan Dunia, kelmarin, mengundang tekad jurulatih beregu itu untuk merancang semula hala tuju anak didiknya itu.

Sambil mengakui yang pemainnya itu masih kekurangan dari banyak segi, Rexy berkata, masalah utama Kien Keat-Boon Heong adalah ketika berdepan gandingan kedua berbanding pasangan utama negara yang kuat dalam acara beregu.

Menurutnya, Kean Kiat-Boon Heong tidak kisah jika bertemu pasangan utama dari China, Cai Yun-Fu Haifeng, Mathias Boe-Carsten Mogensen (Denmark), Lee Yong Dae-Jung Jae Sung (Korea) kerana mereka berupaya menangani lawan. Jika tewas sekalipun, menurutnya, saingan pasti sengit.

"Masalah mereka mungkin ketahanan mental. Tapi, hakikatnya, beregu kedua itu yang memang sering menimbulkan masalah buat Koo dan Tan. Mereka bagaikan tidak tahu bagaimana hendak menewaskan lawan.

"Itu yang berlaku apabila mereka tidak boleh menewaskan Ko (Shun-hyun) dan Yoo (Yeon Seong) sedangkan mereka sekadar beregu kedua Korea. "Kini, tanggungjawab saya untuk duduk semula dengan semua pihak bagi mencari jalan bagaimana Koo dan Tan boleh keluar daripada masalah ini kerana Olimpik sudah tidak lama lagi," katanya.

Setahun selepas Rexy mengendalikan skuad beregu negara pada 2006, Kien Keat-Boon Heong begitu menyerlah sebelum prestasi merudum pada 2008 dan 2009 dan bangkit semula pada 2010.

Badminton: Rexy Mainaky awarded PR status

Former Indonesian Olympic cham and now Malaysia’s national badminton doubles coach Rexy Mainaky and his family have been awarded PR status.

For those who are uninitiated, Rexy is one of the most gifted coup and most successful foregin coach hired by Badminton Association of Malaysia (BAM).

He inherited the doubles squad which were stagnant in 2005 but his focus in instilling discipline and improving the work ethics of the players has started to bear fruits.

It’s his uncanny ability to form effective partnership saw the birth of Koo Kien Keat-Tan Boon Heong (currently ranked world number 2 at the latest world ranking release), who in their first six months, took the doubles scene by storm as they went on to win the Doha Asian Games gold in December, the Malaysia, All England and Swiss Opens.

Rexy said the PR status came as a "surprise" and that he was indebted to the nation.

"I had at one stage denied Malaysia from winning the men’s doubles title at the Olympics but now my target is to ensure Malaysia wins the title. We would start by winning the World Championships (to be held in Kuala Lumpur on Aug 13-19)," he said.

KUALA LUMPUR: Bukan saja dirogol dan disamun, malah wajahnya turut disimbah sejenis cecair dipercayai asid menyebabkan mangsa berdepan risiko kemungkinan buta dan kini terlantar menerima rawatan di hospital.

Itu nasib yang menimpa seorang wanita bujang dan tinggal bersendirian selepasnya rumahnya dicerobohi seorang penjenayah bertopeng, petang kelmarin.

Dalam kejadian kira-kira jam 6.30 petang itu, mangsa yang berusia 32 tahun baru pulang ke rumahnya di Seksyen 2, Wangsa Maju, di sini, selepas membeli juadah untuk berbuka puasa di bazar Ramadan berhampiran.

Menurut sumber polis, sebaik tiba di rumah, mangsa membuka kunci pintu rumahnya tanpa menyedari seorang lelaki menceroboh masuk dan bersembunyi.

"Selepas meletakkan juadah berbuka di dapur, mangsa masuk ke bilik untuk menukar pakaian sementara menunggu waktu berbuka dan ketika itu lelaki terbabit yang bertopeng menghampiri mangsa dan merogolnya," katanya.

SHAH ALAM 9 Ogos – Gabungan 45 pertubuhan bukan kerajaan (NGO) Islam mempersoalkan niat sebenar pihak Gereja Methodist Damansara Utama, Petaling Jaya sekali gus menimbulkan keraguan apabila mengedarkan kuiz mengenai agama Islam kepada hadirin pada majlis makan malam di gereja berkenaan, 3 Ogos lalu.

Wakil NGO tersebut, Dr. Dzulkhaini Husain percaya gereja itu mempunyai agenda tersendiri apabila mengedarkan kertas soalan kuiz itu kerana ketika Jabatan Agama Islam Selangor (JAIS) membuat pemeriksaan, hampir 80 peratus hadirin adalah bukan Islam.

Malah katanya, paling meragukan ialah pihaknya difahamkan JAIS menemui kertas soalan kuiz tersebut yang dikoyakkan dan dibuang di dalam tong sampah ketika pemeriksaan dilakukan.

"Ini yang kita persoalkan. Apa rasional pihak penganjur majlis itu mengadakan kuiz yang menjurus mengenai soalan yang berkaitan hal-hal agama Islam sedangkan majoriti hadirin bukan Islam manakala lokasi penganjuran dibuat di gereja.

"Jadi, apa sebenarnya niat pihak penganjur mengadakan kuiz itu yang merupakan salah satu program dalam majlis tersebut," katanya kepada Utusan Malaysia di sini hari ini.

Menurut Dzulkhaini, 12 soalan yang dikemukakan dalam kuiz itu antaranya 'apakah maksud perkataan Islam', 'apakah maksud perkataan muslim', 'apakah maksud perkataan Quran', 'apakah 5 rukun Islam' dan 'apakah 6 perkara iman muslim' tidak signifikan untuk ditanya kepada orang bukan Islam.

"Kenapa soalan-soalan ini yang menjadi keutamaan pihak penganjur. Adakah orang bukan Islam yang berada di gereja itu menyertai kuiz itu?" soalnya.

Dzulkhaini yang juga Pengerusi Persatuan Sahabat Pusat Perubatan Universiti Malaya (PPUM) berkata, berdasarkan atur cara majlis itu, antara acara yang diadakan ialah tarian, ucapan, makan malam dan persembahan muzik.

"Dalam majlis itu turut diselitkan nyanyian 'Allahuakbar dan Alhamdulillah' yang dicatatkan di antara pukul 8.50 malam hingga 9.25 malam," katanya.

MAS, AirAsia all set to ink partnership deal

KUALA LUMPUR: Malaysia Airlines is set to partner Asia's largest budget carrier, AirAsia, in a deal that would allow the Malaysian air carriers to better compete against regional rivals, particularly Singapore Airlines.

The announcement is likely to be made by the government this week, by Wednesday at the latest, said a source close to the deal.

"It's a done deal and it would mean we could compete better," he added.

The Edge business weekly magazine, which also quoted unnamed sources, said the two could form a "working partnership".

This would involve Khazanah Nasional Bhd having stakes in both MAS and AirAsia's major shareholder, Tune Air Sdn Bhd.

Khazanah Nasional Bhd declined to comment.

With the possible partnership between MAS and AirAsia, the combined fleet size will be 179 aircraft.

According to the data in planspotter.net, MAS has 96 aircraft, 18 under FireFly while AirAsia has 54 and AirAsia X operates 11 aircraft. Singapore Airlines has 106 aircraft.

More destinations will also be covered should MAS and AirAsia pool their resources.

To date, MAS flies to 88 destinations and AirAsia to 74 cities. Singapore Airlines, however, operates passenger services to more than 60 cities in more than 80 countries.

It is learnt that MAS will swap shares with AirAsia in a move that could see AirAsia chief executive officer Tan Sri Tony Fernandes getting a 20 per cent stake in the national carrier.

This will allow both Malaysian carriers to rationalise their fleet frequencies and destinations within the country and abroad while ensuring MAS returns to becoming a premier airline.

About a month ago, MAS surprised the market when it reported a first-quarter operating loss of RM267 million. This had led many analysts to forecast a net loss for the airline in the current financial year.

MAS also hired Tan Sri Md Nor Yusof as its new chairman from Aug 1 this year.

He was picked to be the airline's managing director in 2001 when it was near collapse and helped to push through a massive revamp to put the airline on a stronger footing.

Another major airline in the region, Cathay Pacific, has 127 aircraft and flies to more than 111 destinations worldwide.

Segelintir pihak Kristian hari ini menjadi semakin berani. Desakan, tuntutan dan ugutan dikemukakan kepada kerajaan, walaupun bilangannya kurang daripada 10 peratus. Peluang keemasan ini dimanipulasikan sepenuhnya dalam keadaan umat Islam negara ini begitu tersepit dengan perpecahan yang melanda. Sebelum ini, mereka mendesak kerajaan menubuhkan kementerian hal ehwal bukan Islam. Tindakan ini begitu mencabar kesucian Islam dan mengundang bahaya kepada kedudukan agama Islam selaku agama majoriti dan agama persekutuan jika dibenarkan.

Kebetulan pula, seorang kawan baik saya berketurunan India, beragama Kristian, bersimpati dengan Islam, menelefon saya baru-baru ini. Beliau yang mengajar di salah sebuah sekolah kebangsaan di Kuala Lumpur, mengadukan kepada saya mengenai seorang murid Melayu darjah satu yang diajar oleh guru tuisyen Kristian berbangsa Cina mengenai Kristian dan menghafal lagu-lagu Kristian. Saya mendengar lagu-lagu yang dinyanyikan oleh murid tersebut dengan teliti melalui telefon bimbit guru tersebut yang diserahkan kepadanya. Ternyata, anak kecil yang masih mentah dan tidak berdosa ini telah dicorakkan oleh guru Kristian tersebut melalui kelas tuisyen.

Tindakan guru tuisyen benar-benar keterlaluan dan amat kurang ajar. Saya amat mengharapkan pihak berkuasa akan mengambil tindakan tegas sebelum nasi menjadi bubur. Cukuplah dengan beberapa orang yang telah dimurtadkan secara berani seperti Aishah Bukhari, Azlina Jailani dan sebagainya. Ramai lagi sebenarnya yang menjadi mangsa, ini tidak termasuk yang masih belum dibuktikan. Hakikatnya, perancangan Kristian untuk menjadikan Malaysia sebagai syurga gerakan dakwah mereka memang tidak dapat dinafikan. Ianya bermula sejak mereka di bangku sekolah. Berhati-hatilah dengan guru-guru dan paderi-paderi musang berbulu ayam ini. Mereka akan menggunakan segala platform yang ada, atas nama pertubuhan, kelas tuisyen dan apa jua ruang dan peluang. Tindakan mereka begitu jelas bercanggah dengan perlembagaan persekutuan. Apakah kita masih mahu terus berdiam diri dan bersangka baik?

Berita terbaru mengenai tindakan Jabatan Agama Islam Selangor (Jais) melakukan pemeriksaan ke atas Gereja Methodist Damansara Utama, di Petaling Jaya kerana terdapat bukti wujudnya percubaan memurtadkan umat Islam di negeri ini langsung tidak mengejutkan saya. Saya amat yakin perancangan jahat ini memang telah lama berlaku. Jika tidak percaya tanya exco Kristian dalam kerajaan negeri Selangor. Cuma dia pura-pura tidak tahu apabila ditanya. Begitu juga paderi-paderi yang terlibat. Ibarat lontar batu sembunyi tangan. Mereka akan cari seribu satu alasan untuk menunjukkan bahawa mereka tidak bersalah. Malangnya kita terlalu berlembut kerana takut undi lari dan kalah dalam pilihan raya. Sedangkan mereka begitu bersatu tanpa berbelah bahagi mempertahankan tindakan mereka.

Kita selalu bertindak menjaga kepentingan jangka pendek, melupakan kepentingan jangka panjang. Jika beginilah cara kita berpolitik, saya amat bimbang semakin ramai orang Melayu akan menjadi Kristian suatu masa nanti. Jangan perjudikan masa depan Islam, buruk padahnya. Gunakan peruntukan perlembagaan sedia ada. Lindungilah Islam sebelum terlambat.

Saya amat mengharapkan kita tidak akan tunduk kepada penafian mereka, seolah-olah mereka tidak bersalah. Mereka mesti disiasat mengikut Seksyen 10 Enakmen Jenayah Syariah 1995. Seksyen itu memperuntukan mereka yang menghina Islam atau menyebabkan agama itu dipandang hina; mempersendakan, mengajuk-ajuk atau mencemuh amalan atau upacara yang berhubungan dengan agama Islam adalah melakukan suatu kesalahan. Mereka yang disabitkan kesalahan itu boleh didenda tidak melebihi lima ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya. Ikut saya, peruntukan ini terlalu ringan, undang-undang ini perlu dihalusi lagi untuk diberatkan lagi hukumannya.

Walaupun pihak Kristian menafikan tindakan mereka dengan mengatakan bahawa majlis makan malam diadakan dalam semangat 1Malaysia oleh Harapan Komuniti (NGO Kristian), bertujuan menawarkan bantuan kepada golongan yang tidak bernasib baik dan memerlukan. Semua itu adalah alasan sahaja. Mereka mahu berselindung di sebalik kerja-kerja amal. Dua puluh tujuh tahun dahulu, ketika saya menganut agama Kristian, helah ini juga digunakan untuk mengKristian pelajar-pelajar di asrama. Saya tahu perancangan licik mereka.

Saya memohon kepada Duli-Duli Yang Maha Mulia Tuanku supaya campurtangan dan menjaga kesucian agama Islam daripada perancangan licik segelintir paderi-paderi Kristian ultra kiasu ini sebelum nasi menjadi bubur.

Jika kita mahu pastikan negara-negara Melayu Islam tidak tercemar lagi, seperti pencemaran yang telah mereka lakukan di Singapura dan Indonesia, tidak ada cara lain, selain bertindak tegas menggunakan peruntukan perlembagaan sedia ada. Jangan berlengah lagi. Tindakan perlu diambil terhadap golongan lempar batu sembunyi tangan.

Saya yakin ibu bapa murid tersebut tidak tahu menahu akan perkara tersebut. Jika ibu bapa murid tersebut tahupun, mereka tidak akan mensensasikan isu tersebut. Inilah sifat orang Melayu yang kadangkala meresahkan saya. Kepala sudah dipijak-pijak tetapi masih terus berlembut.

Berbeza sekali dengan sikap agresif ultra kiasu menangani iklan Ramadan TV8 yang dikatakan rasis. Bila hak mereka tercuit sedikit, heboh satu dunia seolah-olah negara bertuah ini begitu zalim terhadap mereka.Saya berulang kali menonton iklan tersebut melalui sebuah laman web. Saya tidak nampak di mana rasis sebagaimana yang didakwa. Tema sekadar menghormati agama sensitiviti umat Islam. Ia tidak ada kaitan sama ada iman kita lemah atau kuat. Takkan sekian lama hidup di negara bertuah ini masih tidak tahu atau tidak faham sensitiviti umat Islam? Apa erti agama Islam sebagai agama persekutuan jika tidak difahami dan dihormati.

Niat iklan tersebut adalah baik. Tetapi telah dimanupulasikan dan disensasikan. Beradab dan bersopan, adalah tuntutan semua agama. Menghormati agama Islam sebagai agama rasmi negara, adalah wajar terutama di bulan Ramadan. Adalah kurang adab jika kita makan di khalayak ketika umat Islam sedang berpuasa, atau sengaja memakai pakaian yang tidak senonoh, yang ditentang oleh semua agama.

Sama seperti mengunjungi majlis kematian orang bukan Islam. Adalah tidak manis jika umat Islam datang dengan pakaian berwarna merah. Saya yakin jika ada umat Islam datang dengan berbaju merah ketika majlis kematian, sudah tentu akan heboh 1Malaysia. Ini yang dikatakan bila kita lakukan sesuatu dikatakan rasis, tidak sensitif, tidak menghormati hak orang Islam.

Bila mereka yang melakukannya itu dikatakan sebagai hak. Ini bukan bermakna agama lain tidak perlu dihormati. Namun, oleh kerana agama Islam adalah agama majoriti dan agama rasmi pula, saya fikir tidak salah jika bukan Islam memberikan sedikit penghormatan. Memang secara peribadi tidak teruja langsung orang makan di depan saya atau mahu telanjang sekalipun ketika berpuasa, nak muntah ada, tetapi kita bercakap soal adab sopan dan sensitiviti.

Siapa yang akan mempertahankan kesucian agama Islam jika bukan kita. Janganlah menggantung harapan bahawa orang lain akan mempertahankan kita. Bila hak ita diambil itu dikatakan hak, bila hak mereka diambil, itu dikatakan rasis dan tidak adil. Licik sungguh politik dan strategi mereka. Apakah ini bukan ultra kiasu namanya? Apabila kerajaan melarang menggunakan nama Allah, menahan Al-Kitab (bible) dalam bahasa Melayu untuk diedarkan, maka berkokoklah mereka dengan mengatakan itu hak mereka. Namun, apabila kita melarang mereka menyebarkan agama Islam kepada orang Melayu kerana bertentangan dengan perlembagaan, maka mereka mencari seribu satu alasan untuk menjustifikasikan tindakan biadab ini.

Bila kita kemukakan bukti nanti, mereka akan canangkan kepada dunia, Malaysia tidak ada kebebasan beragama. Maka gagasan 1Malaysia akan dijadikan hujah untuk mempertahankan tindakan mereka. Malangnya sungguh gagasan ini, sengaja dimanipulasi untuk menghalalkan tindakan mereka. Akhirnya, kita salah, mereka yang betul.

Tidak kurang juga banyak iklan-iklan mengenai perlakuan negatif realiti orang melayu seperti merempit, menagih dadah dan pelbagai lagi, tetapi orang Melayu tidak pernah melompat seperti ultra kiasu ini. Bila kena pada mereka semuanya sensitif, namun bila kena pada kita sebagai umat Islam, mereka senyap sahaja dan kalangan mereka bertepuk tangan.

Pemimpin Melayu perlu bersatu dalam isu akidah

KUALA LUMPUR 6 Ogos - Pemimpin Melayu sepatutnya bersatu dalam isu akidah, bukannya melatah sehingga menyalahkan Jabatan Agama Islam Selangor (JAIS) dalam isu pemeriksaan ke atas Gereja Methodist Damansara Utama, jika benar tindakan itu dibuat demi menyelamatkan akidah orang Islam.

Timbalan Ketua Dewan Pemuda Pas, Nik Abduh Nik Abdul Aziz berkata, contoh yang ditunjukkan segelintir pemimpin Melayu dalam isu tersebut adalah tidak betul kerana tegasnya, selaku Muslim adalah wajib memelihara dan mempertahan akidah umat Islam yang lain.

Menurutnya, walau apa sekalipun pendirian politik setiap pemimpin berkenaan, mereka perlu meletakkan kepentingan Islam melebihi segalanya dalam isu berkenaan, kerana tindakan JAIS itu berhubung kait dengan dakwaan berlakunya penyebaran agama Kristian kepada orang Islam.

"Kalau benar dakwaan itu (penyebaran agama Kristian) wujud, kita (Pemuda Pas) memandang berat perkara ini kerana selain menyalahi Perlembagaan Persekutuan, ia membabitkan soal akidah. Jadi wajib ke atas semua Muslim termasuk JAIS untuk menyelamatkan akidah umat Islam.

"Kita kena letak agama di depan. Islam kena melebihi segala kepentingan lain dan adalah tidak betul kalau pemimpin (Islam) tertentu terlalu cepat melatah dalam perkara ini. Sepatutnya kita bersatu dalam soal agama," katanya ketika dihubungi Mingguan Malaysia, di sini hari ini.

Nik Abduh membuat kenyataan tegas itu ketika sebahagian besar pemimpin Pas lain dilihat ragu-ragu untuk mempertahankan tindakan JAIS atau berdiri di belakang Exco Selangor, Datuk Dr. Hasan Mohd. Ali, sebaliknya ada antara mereka secara terbuka mempertikai tindakan jabatan berkenaan.

Meskipun anak kepada Mursyidul Am Pas itu tidak menyatakan secara tepat siapa pemimpin politik yang dimaksudkan, tetapi ia dipercayai merujuk kepada Menteri Besar Selangor, Tan Sri Abdul Khalid Ibrahim dan Timbalan Pesuruhjaya Pas Selangor, Khalid Abdul Samad.

Ini kerana, Menteri Besar Selangor itu kesal dengan tindakan JAIS dan memberitahu, niat serta tujuan baik jabatan itu tidak menghalalkan perbuatan yang gagal mempamerkan keadilan dan kebijaksanaan, manakala Khalid pula berkata, JAIS perlu ada 'kawalan diri'.

Mengulas lanjut, Nik Abduh berkata, walaupun umat Islam merupakan majoriti di negara ini tetapi ia tidak memberi apa-apa kelebihan, jika pemimpin Melayu tidak bersatu dalam hal yang sepatutnya mereka bersatu, terutamanya isu membabitkan agama.

Dalam pada itu, beliau menambah sudah tiba masanya untuk kerajaan memperkasakan undang-undang sedia ada dan Artikel 11 Perlembagaan Persekutuan agar tiada ruang untuk mana-mana pihak mencabar kesucian agama Islam di mahkamah sivil.

Isu Wahabi: Kusut pada metodologi, bukan pada hati

Isu 'fahaman Wahabi mempunyai perkaitan dengan terorisme dan mengancam keselamatan negara', tercetus hasil peranan beberapa agamawan tertentu. Peranan yang mereka mainkan menyebabkan pihak yang bertanggungjawab terhadap keselamatan, akhirnya menerima fahaman Wahabi boleh memberi ancaman kepada keselamatan negara.

Inilah susur galur kemunculan isu ini.

Ringkasnya, ia muncul bukan disebabkan percaturan politik untuk kepentingan pihak tertentu. Ia juga tidak membabitkan mana-mana parti politik, seperti yang didakwa sesetengah pihak.

Salah seorang individu yang dilabel sebagai pengikut Wahabi, yang juga seorang ahli sebuah parti politik, turut menafikan penglibatan partinya itu dalam isu ini.

Hakikat ini perlu dimaklumi bagi sesiapa juga yang berusaha menangani isu ini atau cuba memahaminya.

Isu utama berhubung perkara ini ialah punca fahaman Wahabi didakwa berpotensi mendorong pengikutnya berfikiran radikal, dan seterusnya menjurus mereka ke arah terorisme. Punca ini perlu dikenal pasti kerana jika tidak, perbuatan melabel orang lain sebagai Wahabi, akan terus berlaku.

Puncanya bukan disebabkan kemahuan sesetengah pihak mencantas individu tertentu dari terus menganggotai parti politik tertentu. Ini kerana, tidak semua individu yang dilabel sebagai Wahabi, adalah ahli parti politik terbabit.

Mencantas

Malahan, ramai dari kalangan yang dilabel Wahabi, dilabel sedemikian sebelum mereka menganggotai parti politik lagi. Lebih dari itu, individu yang menjadi rakyat sebuah negara di utara tanah air, turut dilabel sebagai Wahabi.

Soal mencatas disebabkan perkiraan politik, jelasnya tidak timbul.

Ia bukan juga disebabkan niat jahat agamawan-agamawan 'tertentu' tadi untuk mengenakan fahaman Wahabi dan pengikutnya. Ini adalah berdasarkan pengamatan penulis terhadap tulisan-tulisan dan aktiviti agamawan-agamawan 'tertentu' tadi. Di samping persahabatan penulis dengan agamawan yang lantang 'berjihad' menentang Wahabi.

Punca isu ini-secara asasnya-ialah kepincangan metodologi yang digunakan agamawan-agamawan 'tertentu' tadi dalam mengamati fahaman Wahabi.

Metododolgi yang pincang ini, menemukan mereka dengan satu rumusan yang tersasar, iaitu 'fahaman Wahabi boleh membawa pengamal dan pengikutnya ke arah pemikiran radikal, dan kemudian ke arah terorisme'.

Metodologi yang mereka gunakan ialah menjadikan 'sikap keras dan tidak bertolak ansur fahaman Wahabi berhubung beberapa perkara', sebagai hujjah untuk mendakwa fahaman itu berpotensi membentuk pemikiran radikal, dan seterusnya terorisme.

Sikap keras dan tidak bertolak ansur Wahabi itu ialah tindakan mereka menghukumkan beberapa pengamalan majoriti umat Islam di seluruh dunia, khususnya di Malaysia, sebagai bid'ah, sesat dan syirik yang menjadikan seseorang itu murtad.

Bid'ah

Sebagai contoh, amalan menyambut Maulud Nabi dan peristiwa Israk Mi'raj. Aliran Wahabi menghukumkannya sebagai bid'ah. Bid'ah pula adalah sesuatu yang sesat. Manakala setiap yang sesat, tempatnya di neraka.

Demikian juga amalan kenduri arwah dan tahlil. Juga dipandang bid'ah oleh aliran Wahabi.

Lebih daripada itu, mereka memutuskan, amalan bertawassul dengan orang yang telah mati, adalah perbuatan syirik yang menjadikan seseorang itu murtad.

Masalah timbul apabila kesemua contoh pengamalan tadi (kecuali kenduri arwah) difatwakan harus oleh majoriti ulama sejak dahulu hingga sekarang. Ekoran itu, ia diamalkan oleh majoriti umat Islam, khususnya di Malaysia sejak zaman berzaman.

Satu lagi isu besar berkaitan Wahabi ialah penolakan mereka terhadap mazhab majoriti umat Islam, termasuk Malaysia dalam bidang akidah, iaitu mazhab Asya'irah. Sesetengah agamawan 'tertentu' tadi mendakwa, fahaman Wahabi menghukumkan mazhab Asya'irah ini sebagai sesat.

Pada titik ini, para agamawan 'tertentu' tadi akan membuat kesimpulan dan rumusan mereka sendiri. Rumusan mereka ialah 'fahaman Wahabi berpotensi membentuk pemikiran radikal dan seterusnya terorisme di kalangan pengikutnya'.

Asas kepada rumusan ini ialah pandangan aliran Wahabi-dalam konteks Malaysia- terhadap majoriti umat Islam di Malaysia. Iaitu mereka sesat, mengamalkan bid'ah dan kafir disebabkan mereka melakukan sambutan maulud Nabi, berpegang kepada akidah berasaskan mazhab Asya'irah dan bertawassul dengan orang yang telah mati.

Bertindak ganas

Sesuatu fahaman yang melihat umat Islam yang lain sebagai sesat, ahli bid'ah dan kafir, akan terdorong untuk bertindak ganas terhadap mereka yang dipandang sedemikian. Ia juga boleh mendorong pengikut fahaman sebegini, melakukan kekerasan dan keganasan bagi mencegah dan menghapuskan kesesatan, kekufuran dan bid'ah yang berlaku.

Demikianlah rumusan yang disimpulkan agamawan-agamawan 'tertentu' itu tadi.

'Sikap keras dan tidak bertolak ansur fahaman Wahabi' inilah yang dimaksudkan sesetengah agamawan 'tertentu' tadi, sebagai bukti-bukti yang menunjukkan fahaman Wahabi boleh membawa kepada pemikiran radikal dan terorisme.

Pada titik ini, tercetus satu persoalan asas dan utama berhubung isu ini. Apakah pewartaan beberapa amalan yang dilakukan majoriti umat Islam sebagai bid'ah, sesat atau syirik oleh fahaman Wahabi, boleh mendorong mereka bertindak ganas?

Jika jawapannya 'ya', maka kita akan berhadapan dengan masalah besar. Sebab dalam al-Quran dan hadis Nabi SAW sendiri, banyak pengisytiharan berkenaan status banyak perkara sebagai sesat, kafir, jahiliyyah dan lain-lain.

Seperti contoh, al-Quran menyifatkan orang-orang yang tidak beriman kepada Allah selaku pencipta mereka, sebagai lebih sesat daripada binatang ternakan. Mereka juga disifatkan memiliki akidah yang najis. Manakala pemerintah Islam yang tidak melaksanakan hukum Allah pula disifatkan sama ada zalim, fasik atau kafir.

Begitu juga dengan hadis-hadis Nabi. Ia melaknat peminum arak dan semua pihak yang terbabit dalam industri arak. Demikian juga pemberi dan penerima rasuah. Juga dilaknat oleh hadis Nabi. Hadis Nabi juga menghukumkan seseorang yang meninggalkan solat secara sengaja, menjadi murtad seperti pandangan mazhab Hambali.

Zalim, fasik, sesat?

Apakah boleh disimpulkan bahawa al-Quran dan Sunnah mengandungi pemikiran yang boleh membawa kepada terorisme, disebabkan ketegasannya memutuskan perkara-perkara ini sebagai zalim, fasik, sesat, kafir atau laknat?

Tentu sekali tidak. Ini kerana al-Quran dan Sunnah juga, dalam masa yang sama, menjelaskan pendekatan yang wajib digunakan dalam menyebarkan ajarannya.

Ringkasnya, sikap keras dan tidak bertolak ansur aliran Wahabi seperti yang dinyatakan, tidak boleh dijadikan hujjah bahawa fahaman itu boleh membawa pengikutnya kepada terorisme.
Ini kepincangan pertama metodologi agamawan-agamawan 'tertentu' tadi dalam menangani isu fahaman Wahabi ini.

Kepincangan kedua ialah mereka tidak melihat secara keseluruhan fahaman Wahabi. Mereka hanya melihat 'sikap keras dan tidak bertolak ansur Wahabi berhubung beberapa perkara' yang dinyatakan, kemudian terus membuat rumusan bahawa aliran ini boleh membawa pengikutnya kepada pemikiran radikal dan terorisme.

Malangnya, mereka 'terlupa' untuk turut melihat pendekatan yang dipegang oleh fahaman Wahabi dalam menyebarkan fahaman mereka. Meskipun fahaman ini bersikap tegas secara berlebihan dan tidak bertolak ansur dalam soal-soal yang dinyatakan, namun pendekatan mereka tidak sedemikian.

Sesiapa juga-termasuk agamawan-agamawan 'tertentu' tadi-mengetahui bahawa fahaman Wahabi ialah satu "manhaj (metod) yang memfokuskan kepada aspek tasfiah dan tarbiah".

Definisi tentang fahaman Wahabi ini bersumberkan kenyataan Syaikh Albani, tokoh Salafi besar di zaman moden, yang memfokuskan gerak kerja beliau kepada aspek tasfiah dan tarbiah.

Pembersihan akidah

Tasfiah bermaksud pembersihan. Yang dimaksudkan di sini ialah pembersihan akidah dari segala khurafat dan ibadat dari segala bid'ah. Manakala 'tarbiah' bermaksud pendidikan. Iaitu mendidik umat Islam dengan didikan al-Quran dan Sunnah.

Bertitik tolak dari sini, fahaman Wahabi menolak pendekatan jihad atau pendekatan politik dalam menyebarkan fahaman mereka tentang Islam. Syaikh Albani secara terang-terangan menggesa umat Islam menjauhi politik.

Sebab itulah, dalam persekitaran fahaman Wahabi, masyhur kata-kata yang berbunyi "sebahagian daripada politik itu, ialah meninggalkan politik".

Penolakan mereka terhadap pendekatan politik juga disebabkan oleh konsep ketaatan kepada pemerintah yang agak berlebihan yang menjadi pegangan mereka. Mereka menyeru masyarakat mentaati pemerintah biarpun "pemerintah menyebat belakang mereka dan mengambil harta mereka", selama mana pemerintah itu mengizinkan rakyat mendirikan solat.

Pemikiran dan sikap aliran Wahabi secara umum, boleh dilihat melalui slogan mereka yang berbunyi "La Nukran Wala Hajran Wala Khuruj" (Tiada pengingkaran, pemulauan dan pemberontakan).

Rentetan daripada konsep ketaatan yang berlebihan ini juga, mereka mengharamkan penubuhan parti-parti politik dalam Negara Islam. Demikian juga demonstrasi membantah atau menuntut sesuatu dari pihak pemerintah. Ia juga haram.

Menurut fahaman Wahabi, satu-satunya aktiviti politik yang boleh dipraktikkan oleh rakyat ialah menasihati pemimpin. Itupun secara tertutup dengan cara menarik tangan pemimpin ke tempat tertutup untuk memberi nasihat.

Inilah pemikiran aliran Wahabi berhubung pendekatan dakwah.

Andainya para agamawan 'tertentu' tadi mengambil kira pendekatan aliran Wahabi yang lunak ini, tentu rumusan dan kesimpulan mereka tentang aliran ini tidak seperti yang ada sekarang.

Jadi pengganas

Justeru, adalah sesuatu yang tidak terlintas di fikiran bahawa aliran ini boleh dilabel sebagai berpotensi menjadikan pengikutnya pengganas. Dalam masa sama, ia suatu yang agak melucukan.

Tepat sekali catatan dalam satu portal, bahawa gerombolan ulama muda yang berpegang kepada semua pendekatan dakwah aliran Wahabi yang dinyatakan tadi, langsung tidak berpotensi dan berbakat untuk menjadi pengganas!

Malangnya, agamawan-agamawan 'tertentu' tadi tidak mengambil kira pendekatan dakwah aliran Wahabi yang dinyatakan ini dalam menentukan sikap mereka terhadap aliran ini. Yang mereka lihat dan jadikan asas ialah 'sikap keras dan tidak bertolak ansur fahaman Wahabi' berhubung persoalan-persoalan yang dinyatakan sebelum ini, mengakibatkan rumusan mereka tentang Wahabi tersasar.

Ironinya, metodologi yang pincang akan menatijahkan rumusan dan dapatan yang 'tempang'.

Saya menyeru agar semua pihak berlaku adil terhadap kawan dan lawan, sesuai dengan semangat al-Quran yang menegah kita bersikap tidak adil disebabkan kebencian kita terhadap sesuatu pihak.

Adalah sesuatu yang sangat malang bagi umat Islam di Malaysia, jika kerana metodologi yang tempang ini, menyebabkan banyak pihak dilabel sebagai berpotensi menjadi pengganas.

Lebih malang lagi, jika disebabkan metodologi yang tempang ini, beberapa orang saudara seagama dari Tanah Arab dan Bumi Afrika, telah diusir keluar kerana menganut fahaman Wahabi yang dihukumkan sebagai boleh membawa kepada keganasan berdasarkan metodologi yang tempang tadi.

Kepada semua pihak, ikutilah metodologi yang betul dan bertaqwalah kepada Allah dalam membuat sesuatu keputusan.

Datuk Seri Anwar Ibrahim is an opportunist who was the mastermind in organising the illegal rally yesterday, said Datuk Seri Najib Tun Razak.

The Prime Minister described the illegal rally organised by the outlawed group, Bersih 2.0, as a desperate plan by the opposition leader to manipulate the people to gain their support.

Najib, who is also the Umno president, said Anwar's position was affected by the growing support of the people for the government following the various economic development policies that had been implemented.

Addressing 6,000 people who attended a briefing session at the Putra World Trade Centre, here today, he said the Member of Parliament for Permatang Pauh was prepared to sacrifice his principles and put aside religion and race as long as he achieved his dream of becoming prime minister.

"He knows that if he does not do anything, we (the Barisan Nasional) will win in the 13th general election.

"This is the last chance for him. When people know that this is their last chance, they will do everything, good or bad," he said.

Najib, who is also the BN chairman, said Anwar deliberately wanted to bring down the country''s image and show to the world that Malaysia was not democratic and instead tried to portray himself as a good person.

"This negative attitude has never changed from before until now," he said.

Banyak orang mungkin sudah lupa bahawa warna kuning cukup sentimental bagi Ahli Parlimen BN-Johor Bharu,Datuk Shahrir Samad.

Sebab itu beliau jadi ‘sakit mata’ tengok gelagat ahli parlimen pakatan pembangkang termasuk adiknya sendiri dari PAS-Shah Alam, Khalid Samad pakai warna kuning ke sidang Dewan Rakyat pada hari Khamis.

Ini gara-gara mereka nak tunjuk solidariti mereka kepada rancangan perhimpunan Bersih 9 Julai yang hangat jadi isu sekarang.

Pada tahun 1988 Shahrir bertanding sebagai calon bebas di kerusi parlimen Johor Bharu. Lambang yang beliau gunakan ialah cap tiga kunci dan warna rasmi kempennya ialah KUNING.

Ketika itu beliau seorang diri berdepan dengan bala jentera BN yang kuat. Namun beliau menang dengan majoriti lebih 12,000 undi.

Beliau mencatat sejarah tersendiri sebagai satu-satunya yang menang bertanding atas tiket calon bebas di kerusi Parlimen Johor Bharu.

Juga jangan lupa Shahrir juga adalah otai@orang lama di Dewan Rakyat. Beliau kini adalah ahli parlimen BN kedua paling senior selepas Tengku Razaleigh Hamzah (BN-Gua Musang.)

Juga dari sudut politik Johor Bharu sehingga kini sinionim dengan Shahrir.

Biasanya sepanjang sidang Dewan Rakyat beliau jarang mahu komen tentang tindak tanduk pembangkang yang buat macam-macam karenah.

Namun sepanjang sidang Khamis yang merupakan hari akhir sesi Parlimen kali ini beliau nampak ‘ geram sikit’.

Ketika sidang hendak mula pada sebelah pagi kelihatan para ahli parlimen pakatan pembangkang sampai dengan macam-macam pakaian kuning. Kebanyakanya yang lelaki pakai tali leher kuning. Ada yang pakai t-shirt kuning dengan kot.

Mereka berlegar di lobi parlimen dan bergaya depan para wartawan dan jurugambar.

“Saya rasa nak tergelak tengok mereka...macam budak-budak,” kata bekas Menteri Perdagangan Dalam Negeri dan Hal Ehwal Pengguna ini ketika bersembang dengan Agendadaily di ruang rehat ahli parlimen.

Katanya waktu bertanding sebagai calon bebas menentang BN dulu beliau tidak pernah langsung bertanya atau mendakwa Suruhanjaya Pilihanraya ini adil ke tidak.

“Saya letakkan nasib saya sepenuhnya kepada para pengundi Johor Bharu...tak ada nak berarak...tak ada nak protes kepada SPR...tak ada nak tuduh proses pilihanraya tak bersih...tak betul.

“ Ini kerana saya yakin dengan sokongan rakyat terhadap perjuangan saya...saya letak jawatan dan bertanding semula sebagai calon bebas...saya guna warna kuning.

“Jadi hari ini yang pakai baju kuning ni saya rasa mereka tak layak...pasal semua bukan jantan...bukan berani...nak komplen pasal SPR...nak komplen tak adil ..tak bersih kononnya...

“kalau kita yakin sokongan rakyat..kita letak jawatan...panggil pilihanraya semula bagi negeri Selangor (misalnya)...ni nak pergi mesyuarat Exco pakai baju kuning..nak pergi Dewan Rakyat pakai baju kuning...nak pergi mesyuarat majlis perbandaran pakai baju kuning...apa ni.

“Kalau berani bubar dewan (negeri yang dikuasai pakatan pembangkang) ..panggil pilihanraya...ini kalau mereka ada keyakinan pada sokongan rakyat....jangan nak kata ini SPR tak adil..SPR tak betul....saya bertanding seorang diri...tak ada pun tuntut SPR tak adil..."

Baginya ini semua helah orang yang tidak ada kewibawaan dan tidak percaya kepada perjuangan dan sokongan rakyat.

“Itu sebab saya ketawa tengok ahli parlimen pakatan pakai baju kuning...kononnya handal...ini semua sembunyi belakang ketakutan diri sendiri...nak menyalahkan orang.

“Kalau kita betul orang sokong kita...kita tak payah nak berarak...nak pakai baju kuning...kita bubarkan dewan serahkan diri kita kepada penentuan rakyat.”tegasnya.-30/6/2011-

Siapakah dia Maya Maju Sdn Bhd yang membina Istana Negara baru yang menelan belanja hampir RM1 billion daripada kos asal RM400 juta?

Semakan daripada ROC mendedahkan yang Maya Maju Sdn Bhd pemegang saham didaftarkan adalah Mr Ko Chin Teck (RM15,000 unit saham), Mr Lo Sin Li (RM85,000 unit saham). Pengarahnya adalah Mr Ko and En Mohamad Muslim Hamzah (Mohamad Muslim tidak memiliki sebarang pegangan saham). Maya Maju Sdn Bhd Company No: 252091-T. Penyata kewangan berakhir sehingga 31 Dis 1993 (yang dilampirkan dalam rekod RoC) dengan nilai Aset Tetap RM82,655.00 and Aset Semasa RM415,169.00 serta Tanggungan Semasa pada RM456,501.00.

Selain itu terdapat syarikat yang didaftarkan melaui ROC dibawah nama Maya Maju (Malaysia) Sdn Bhd, (Reg No: 254750-T). Pengarahnya adalah Datuk Haji Man Bin Mat , Md Nizam B. Md Sharif, Rasidah Bt. KUALA LUMPUR, June 14 — A whopping RM1,758,432 was spent on developing six Facebook pages to promote Malaysian tourism, the Tourism Ministry said today.

Deputy Tourism Minister James Dawos Mamit said this today in reply to a question from Anthony Loke (Rasah-DAP).

Each Facebook page cost RM293,072 — Cuti-Cuti 1 Malaysia, Citrawarna 1Malaysia, Karnival Jualan Mega 1 Malaysia, Festival Pelancongan Seni Kontemporari 1 Malaysia, Kempen 1 Malaysia Bersih and Fabulous Food 1 Malaysia.

The Citrawarna 1 Malaysia page has so far attracted 20,292 Facebook fans since it was launched on May 21.

Mamit said that the RM1.8 million included costs for designing, flash programming and coding, testing and debugging, uploading and launching the application, system server deployment and campaign management.

“You need RM1.8 million to run Facebook pages and applications? A six-year-old can start a Facebook page.

“If Datuk Seri Ng Yen Yen has problems getting people to help start Facebook pages, DAP headquarters can help her out, we have people who can develop these things at no cost,” Loke told reporters later at a press conference.

Science & Theology News asked three leading scientists – Noam Chomsky, Lawrence Krauss and Sean M. Carroll -- to comment on topics in science-and-religion as well as in popular culture. What follows are their answers.

ON WESTERN INTELLECTUALS

CHOMSKY: People that are called intellectuals, their record is primarily service to power. It starts off in our earliest historical records, in the Bible for example. If you look at what the prophets were doing, they were what we would call dissident intellectuals. They were giving geopolitical critique, they were warning that the [Hebrew] kings were going to destroy the country. They were calling for support for suffering people, widows and orphans and so on. So they were what we call dissident intellectuals.

Jesus himself, and most of the message of the Gospels, is a message of service to the poor, a critique of the rich and the powerful, and a pacifist doctrine. And it remained that way, that's what Christianity was up until Constantine. Constantine shifted it so the cross, which was the symbol of persecution of somebody working for the poor, was put on the shield of the Roman Empire. It became the symbol for violence and oppression, and that's pretty much what the church has been until the present. In fact, it's quite striking in recent years, elements of the church — in particular the Latin American bishops, but not only them — tried to go back to the Gospels.

The people who we call intellectuals are no different from anyone else, except that they have particular privilege. They're mostly well-off, they have training, they have resources. As privilege increases, responsibility increases. And if somebody's working 50 hours a day to put food on the table and never got through high school and so on, their opportunities are less than the people who are called intellectuals. That doesn't mean that they're any less intellectual. In fact, some of the best educated people I have known never got past fourth grade. But they have fewer opportunities, and opportunity confers responsibility.

KRAUSS: I too have found that some of the brightest and most accomplished individuals I have known are those without significant academic training. Indeed, for individuals who have a particular intellectual talent, academia may be the safest and least demanding route to choose for a career. One is surrounded by like-minded people, and the most intense academic debate often revolves around issues that have little significance outside of the confines of academe.

Nevertheless, the freedom conferred by an academic position can embolden certain individuals to take the responsibility of an "intellectual" seriously, which is one of the many reasons I support the institution of tenure. I have met many academics who are committed to addressing societies needs, and are willing to speak out against those in power.

I was particularly encouraged for example, to be a part of a recent initiative of the Union of Concerned Scientists that involved a letter signed by 60 scientists, including 20 Nobel Laureates, 19 National Medal of Science Winners, that explicitly and clearly laid out the devastating campaign of the Bush administration against free scientific inquiry and the open access to information.

CARROLL: The primary role of intellectuals should be to promote the truth, whatever it may turn out to be. It's natural to expect that the truth can be in conflict with the interests of entrenched power. The Bible, however, is hard to read as a history of intellectuals; it's a complicated set of books, and the prophets were serving the kings as often as warning against their excesses.

ON SCIENCE

CHOMSKY: Science talks about very simple things, and asks hard questions about them. As soon as things become too complex, science can't deal with them. The reason why physics can achieve such depth is that it restricts itself to extremely simple things, abstracted from the complexity of the world. As soon as an atom gets too complicated, maybe helium, they hand it over to chemists. When problems become too complicated for chemists, they hand it over to biologists. Biologists often hand it over to the sociologists, and they hand it over to the historians, and so on. But it's a complicated matter: Science studies what's at the edge of understanding, and what's at the edge of understanding is usually fairly simple. And it rarely reaches human affairs. Human affairs are way too complicated. In fact even understanding insects is an extremely complicated problem in the sciences. So the actual sciences tell us virtually nothing about human affairs.

KRAUSS: It is absolutely true that science relies on extreme simplifications in order to be effective. The more "basic" the science, the easier it is to isolate the key questions and investigate them. I have often said that I chose to be a physicist because biology was way too complicated.

As a result, as one moves from physics, to chemistry, to biology, to social science, the ability to isolate questions, and provide definitive answers becomes progressively more difficult. But I think I would say that science is based on being able to address difficult questions and find simple answers.

Moreover, I disagree that whenever one is at the edge of understanding, things appear far from simple. They are only simple after one understands them. It may be true understanding that human affairs may be yet far more complicated than, say, quantum gravity, but that doesn't change the fact that the edge of understanding in science is always confusing until a good theory has been developed.

CARROLL: When Galileo first realized that he could understand motion by considering idealized situations without friction or air resistance, he set modern science in motion. The real world is a complicated, messy place, and there are many interesting questions about which contemporary science has little to say. However, anyone who has watched a television or gone to a hospital should know that science has nevertheless managed to have a substantial impact on our lives.

ON A HOLISTIC VIEW OF THE WORLD

CHOMSKY: What each of us has is direct experience. So does every other animal, they have some kind of experience. A bee sees the world differently than we do because it is a different organism. And other organisms just try to work their way around the world of their experience. Humans, as far as we know, are unique in the animal world in that they're reflective creatures. That is, they try to make some sense out of their experience.

There are all kinds of ways of doing this: some are called myth, some are called magic, some are called religion. Science is a particular one — it's a particular form of trying to gain some understanding of our experiences, organize them. It relies on evidence, coherent argument, principles that have some explanatory depth, if possible. And that mode of inquiry, which has been, particularly in the last couple hundred years, extremely successful, has its scope and its limits. What the limits are we don't really know.

In fact, if you look at the history of science seriously, in the seventeenth century there was a major challenge to the existing scientific approach. I mean, it was assumed by Galileo and Descartes and classical scientists that the world would be intelligible to us, that all we had to do was think about it and it would be intelligible.

Newton disproved them. He showed that the world is not intelligible to us. Newton demonstrated that there are no machines, that there's nothing mechanical in the sense in which it was assumed that the world was mechanical. He didn't believe it — in fact he felt his work was an absurdity — but he proved it, and he spent the rest of his life trying to disprove it. And other scientists did later on. I mean, it's often said that Newton got rid of the ghost in the machine, but it's quite the opposite. Newton exorcised the machine. He left the ghost.

And by the time that sank in, which was quite some time, it just changed the conception of science. Instead of trying to show that the world is intelligible to us, we recognized that it's not intelligible to us. But we just say, 'Well, you know, unfortunately that's the way it works. I can't understand it but that's the way it works.' And then the aim of science is reduced from trying to show that the world is intelligible to us, which it is not, to trying to show that there are theories of the world which are intelligible to us. That's what science is: It's the study of intelligible theories which give an explanation of some aspect of reality.

Scientists typically don't study the phenomenal world. That's why they do experiments. Our phenomenal world is way too complex. If you took videotapes of what's happening outside your window, the physicists and chemists and biologists couldn't do anything with it. So what you try to do is try to find extremely simple cases — that's called experiments — in which you try to get rid of a lot of things that you guess are probably not relevant to finding the main principles. And then you see how far you can go from there — the fact is, not very far.

When people talk about what science tells you about human affairs, it's mostly a joke. Incidentally, I don't think religion tells you very much either. So it's not that science is displacing religion, there's nothing to displace.

KRAUSS: It is absolutely true that science is just one way that humans have of making sense of the world. It happens to be an incredibly successful way, in that it allows predictions to be made that allow unprecedented control over our environment. But I disagree that Newton showed that the world was not intelligible.

It is true that Newton uttered the famous qualifier, "I do not frame hypotheses", but his universal law of gravity actually suggested to many that the world was in fact mechanistic, that the same laws that governed falling apples governed the motion of the planets around the sun. It has been claimed, for example, that the development of Newton's Laws was in part responsible for the ending of the burning of witches, in that it demonstrated that natural effects could have understandable natural causes.

It is absolutely true that Newton's theories, and all scientific theories since, are approximations that give an explanation of only some aspects of nature. But I think most physical scientists at least would argue that by doing so they capture the key operational aspects of the real world of phenomena.

CARROLL: Newton showed that we could construct formal scientific models that are both perfectly intelligible and in good agreement with what we know about the world -- I'm not sure what else it would mean to say that the world is intelligible to us. Of course, it is true that science remains silent on questions of meaning and morality and aesthetics, as it aims simply to describe the world as it is. The understanding that meaning and morality and aesthetics are constructed by human beings, rather than being located in the external world, is one of the most profound lessons of the Enlightenment, one we are still struggling to come to terms with.

ON RELIGION

CHOMSKY: When we talk about religion, we mean a particular form of religion, the form that ended up dominating Western society. But if you take a look at other societies in the world, their religious beliefs are very different.

People have a right to believe whatever they like, including irrational beliefs. In fact, we all have irrational beliefs, in a certain sense. We have to. If I walk out the door, I have an irrational belief that the floor is there. Can I prove it? You know if I'm paying attention to it I see that it's there, but I can't prove it. In fact, if you're a scientist, you don't prove anything. The sciences don't have proofs, what they have is surmises. There's a lot of nonsense these days about evolution being just a theory. Everything's just a theory, including classical physics! If you want proofs you go to arithmetic; in arithmetic you can prove things. But you stipulate the axioms. But in the sciences you're trying to discover things, and the notion of proof doesn't exist.

KRAUSS: Science certainly cannot prove anything to be true, in the sense that mathematics might appear to do. However, what science does extremely well, indeed it is the heart of science, is to prove things to be false. Namely, any proposed explanation that disagrees with the result of experiment is false. Period. It is by eliminating the false theories that we make progress. Falsification is the key.

CARROLL: Science indeed doesn't operate in terms of "proofs," but rather in terms of theories that have been tested beyond reasonable suspicion. The crucial part of the process is approaching the world with an open mind; no matter how elegant or compelling an idea may seem, it can't be accepted if it doesn't agree with the data.

ON ATHEISM

CHOMSKY: You could be an intellectually respectable atheist in the 17th century, or in the fifth century. In fact, I don't even know what an atheist is. When people ask me if I'm an atheist, I have to ask them what they mean. What is it that I'm supposed to not believe in? Until you can answer that question I can't tell you whether I'm an atheist, and the question doesn't arise.

I don't see anything logical in being agnostic about the Greek gods. There's no agnosticism about ectoplasm [in the non-biological sense]. I don't see how one can be an agnostic when one doesn't know what it is that one is supposed to believe in, or reject. There are plenty of things that are unknown, but are assumed reasonably to exist, even in the most basic sciences. Maybe 90 percent of the mass-energy in the universe is called "dark," because nobody knows what it is.

Science is an exploration of very hard questions. Not to underrate the theory of evolution, that's a terrific intellectual advance, but it tells you nothing about whether there's whatever people believe in when they talk about God. It doesn't even talk about that topic. It talks about how organisms evolve.

KRAUSS: Many fundamentalists see scientists are rabid atheists, but in fact, as Steve Weinberg, a Nobel Laureate in Physics, says, most of them haven't thought enough about God to responsibly address the issue of belief. God simply doesn't come up in scientific considerations, so questions of belief or non-belief essentially never arise.

Evolution, as a scientific theory, says nothing about the existence or non-existence of God. It doesn't yet address the origin of life either, but instead deals with the mechanics of how the present diversity of species on earth evolved.

At some point I expect we will understand how the first life forms originated via natural physical mechanisms, but even when we do this, it will not confirm or refute the existence of God. This is the key mistake that fundamentalists who insist that evolution must be wrong make. They assume that because science doesn't explicitly incorporate God, it must somehow be immoral. But in fact science simply doesn't deal with issues of purpose or design to the universe. It deals with how the universe works.

And I believe that the ethos of science -- full disclosure, honesty, anti-authoritarianism -- would, if more generally applied, help produce a more ethical world. Now, this does not mean that there is no tension between religion and science. As Steve Weinberg, a Nobel Laureate in Physics, again put it, "Science does not make it impossible to believe in God, but it does make it possible to not believe in God."

Without science, everything is miraculous. Science alone allows for the rational possibility that there is no divine intelligence. But it does not require it, and that is the important point. Arguing that evolution must be incorrect because it appears to conflict with one's a priori ideas about design in nature is not just bad science, it is bad theology.

CARROLL: Atheism is not merely the view that God does not exist, but the positive statement that the world operates according to immutable laws of nature. As with any other belief system, it has open questions; we don't know what all of those laws are, and in some cases we don't even know what they might look like. When Darwin explained how complex organisms could naturally evolve from simpler forms, he provided a compelling answer to one of the most profound open questions of the materialist worldview.

ON STEVEN JAY GOULD AND "NON-OVERLAPPING MAGISTERIA"

CHOMSKY: Steve Gould [was] a friend. But I don't quite agree with him [that science-and-religion are "Non-Overlapping Magisteria"]. Science and religion are just incommensurable. I mean, religion tells you, 'Here's what you ought to believe.' Judaism's a little different, because it's not really a religion of belief, it's a religion of practice. If I'd asked my grandfather, who was an ultra-orthodox Jew from Eastern Europe. 'Do you believe in God?' he would have looked at me with a blank stare, wouldn't know what I'm talking about. And what you do is you carry out the practices. Of course, you say 'I believe in this and that,' but that's not the core of the religion. The core of the religion is just the practices you carry out. And yes, there is a system of belief behind it somewhere, but it's not intended to be a picture of the world. It's just a framework in which you carry out practices that are supposed to be appropriate.

KRAUSS: Science and religion are incommensurate, and religion is largely about practice rather than explanation. But religion is different than theology, and as the Catholic Church has learned over the years, any sensible theology must be in accord with the results of science.

CARROLL: Non-overlapping magisteria might be the worst idea Stephen Jay Gould ever had. It's certainly a surprising claim at first glance: religion has many different aspects to it, but one of them is indisputably a set of statements about how the universe works at a deep level, typically featuring the existence of a powerful supernatural Creator. "How the universe works" is something squarely in the domain of science. There is, therefore, quite a bit of overlap: science is quite capable of making judgments about whether our world follows a rigid set of laws or is occasionally influenced by supernatural forces. Gould's idea only makes sense because what he really means by "religion" is "moral philosophy." While that's an important aspect of religion, it's not the only one; I would argue that the warrant for religion's ethical claims are based on its view of the universe, without which we wouldn't recognize it as religion.

SHAH ALAM, June 13 — A company director told the High Court here today that he sold his mansion and two plots of land to Dr Mohd Khir Toyo for RM3.5 million despite buying the properties for RM6.5 million as he feared for his business in Selangor.

Ditamas Sdn Bhd director Shamsuddin Haryoni testified in the corruption trial of the former Selangor mentri besar that Dr Khir had rejected his offer of between RM5 million and RM5.5 million, insisting instead on buying his properties in Section 7 here for just RM3.5 million.

"We have projects in Selangor, businesses in Selangor and a mentri besar wants my house for RM3.5 million," said Shamsuddin at the High Court here today.

"So we agreed. I was worried about my position as a businessman and I was afraid that my business would be threatened," he added.The 55-year-old construction and property developer said he was involved in ongoing property projects with state subsidiaries Selangor Development Corporation (PKNS) in Bangi and Permodalan Negeri Selangor Bhd (PNSB) in Sungai Long, Cheras.

Shamsuddin, who wore a black coat, said he bought the house and two plots of land in 2004 for RM5 million and spent RM1.5 million on renovations.

"Datuk Seri Khir Toyo asked me to buy (the properties)... he was interested in the house," Shamsuddin told a packed courtroom.

"I'm a businessman in Selangor. I have projects. So I felt I had no choice and I just proceeded," he said.

Shamsuddin added that Khir had engaged landscape artist Nasir Ismail to design the Umno politician's Balinese-style mansion.

Nasir testified last Thursday that he was paid more than RM6 million for the job, saying that he received five payments from Shamsuddin and eight from Khir of RM500,000 each.

Shamsuddin said today that he sold his properties to Khir, who previously helmed the country's wealthiest state for almost eight years, in 2007.

"I just wanted to give a small discount," said the businessman, when asked why he offered a selling price of RM5 million to RM5.5 million.

Shamsuddin pointed out that he had engaged a property valuer who estimated the value of his properties at RM5.5 million.

Khir, a former Selangor opposition leader, was charged with obtaining the two plots of land and the bungalow, which are located at No. 8 and 10, Jalan Suasa 7/1 L, Shah Alam, for himself and his wife Zahrah Kechik.

If found guilty, the Sungai Panjang assemblyman faces two years' jail, a fine, or both under Section 165 of the Penal Code.

KUALA LUMPUR: The government is studying concession agreements with certain independent power producers.

Prime Minister Datuk Seri Najib Razak said: "The government will explain soon because we are relooking the agreements with certain IPPs." Najib also responded to criticisms that the government was favouring IPPs by allowing lopsided concession agreements.

"The majority of the IPP agreements are no longer as one-sided as before. We are in discussions and it is not true we protect the IPPs. We champion the people," he told a press conference after opening the Ampang Umno divisional meeting and its new building yesterday.

Najib was also asked to comment on the setting up of a cabinet committee, comprising three ministers, namely Minister in the Prime Minister's Department Tan Sri Nor Mohd Yakcop, Energy, Green Technology and Water Minister Datuk Seri Peter Chin and Second Finance Minister Datuk Seri Ahmad Husni Hanadzlah, to look into the issue.

Najib urged all quarters to give the cabinet committee time to study the matter.

"The three ministers are working to find a solution that is acceptable to all." To a question whether the IPP agreementswould be opened to public scrutiny, Najib said the matter would be addressed later and "q uite soon".

In Ipo h, Bernama reported that Ahmad Husni noted that the committee would not confine itself to matters related to IPPs, but include all aspects of power supply as well as subsidies.

He said it would present a report to the cabinet as soon as possible although no deadline had been set.

"The committee will study various aspects (of power supply) and not just relating to the IPP problem... among them (production) costs and (requirements for) the future because some IPP concessions will end in 2014 and 2015." Ahmad Husni said this after opening the Rukun Tetangga beat base for Kampung Tengku Hussin.

He was commenting on a statement by Gua Musang member of parliament Tengku Razaleigh Hamzah, who suggested that the government set up a royal commission of inquiry to look into IPP concessions.

BN on last legs of power, says Kit Siang

KUALA LUMPUR, June 8 — Lim Kit Siang claims Barisan Nasional (BN) is on the verge of electoral defeat, and that proof of this was an Umno minister’s acceptance of the possibility that the country’s next prime minister could come from Pakatan Rakyat (PR).

The DAP parliamentary leader said this in reference to minister in the prime minister’s department Datuk Seri Nazri Aziz’s recent claim that Hadi was aiming to replace Datuk Seri Anwar Ibrahim as PR’s prime minister-designate.

In his analysis of the just-concluded PAS polls, the Umno supreme council member had said a glaring trend had emerged in the usually conservative Islamist party — a newfound lust for power.

“(This) strikes discerning Malaysians as the latest example of the debilitating loss of confidence enveloping Umno and BN leaderships that they are on the last legs of power until the 13th General Election.

“Now a senior Minister of the Najib Cabinet is seriously canvassing the scenario of UMNO and BN losing federal power in Putrajaya and, for the first time in the nation’s history since Merdeka in 1955, a Prime Minister not from Umno after the next 13th general election,” said Lim in a statement today.

Hadi has already stated that he does not want to be prime minister even if Pakatan Rakyat (PR) were to win in the upcoming general election, and explained that PAS’s current goal is to implement a welfare state concept.

Lim (picture) said that as far as PR was concerned, all were in agreement that Datuk Seri Anwar Ibrahim will be the country’s next prime minister should the federal opposition take over Putrajaya.

SHAH ALAM, 31 Mei: Ketua Dewan Pemuda PAS Pusat, Ustaz Nasrudin Hassan at-Tantawi hari ini menegaskan kesediaan PAS untuk menggantikan Umno dalam usaha mentadbir negara ke arah yang lebih baik.

Beliau yang menang tanpa bertanding untuk penggal kedua jawatan itu sesi 2011-2013 berkata, masyarakat dan rakyat sudah merindui satu kehidupan lebih harmoni di bawah panji perjuangan Islam yang diterajui oleh PAS dan sudah lama muak dengan sikap Umno selama ini.

Menurutnya, dalam PAS kini sudah wujud satu badan khas, Dewan Himpunan Penyokong PAS (DHPP) yang dianggotai rakyat Malaysia bukan beragama Islam yang meyakini dasar perjuangan PAS.

Nasrudin berkata demikian ketika bercakap dan menyampaikan hujahnya di dalam Wacana Sinar Harian siri 4 yang diadakan di Kompleks Kumpulan Media Karangkraf (KMK), dekat sini, petang tadi.

Turut menjadi panelis adalah Ketua Pemuda Umno Malaysia, Khairy Jamaluddin Abu Bakar dan bekas Mufti Perlis, Dr Mohd Asri Zainul Abidin dengan pensyarah UIAM, Dr Maszlee Malik sebagai moderator.

Hadirin yang kebanyakannya penyokong kedua-dua belah pihak memenuhi dewan namun tahap kebisingan mereka tidak seteruk suasana wacana bulan lalu yang tidak dikawal dengan sebaiknya.

"Saya mempunyai nekad ingin membawa anggota PAS khasnya pemuda agar mengamalkan dasar dan sistem politik berakhlak, hemah, bermaruah dan tidak tidak mahu politik jijik, keji apatah lagi menjatuhkan dan membina jatidiri di atas sikap kesengsaraan dan penderitaan orang lain," tegas Nasrudin.

Dalam sesi sama, beliau mempertahankan akhbar Harakah yang disifatkan oleh Khairy sesat dan enggan menarik balik tuduhan itu, lantas Nasrudin mempersoalkan tindakan akhbar pro-Umno, Utusan Malaysia, lebih teruk dengan menyiarkan gambar lucah dan menjolok mata pembaca.

Sebelum itu di awal wacana, Nasrudin menyebutkan tentang perjuangan PAS yang meletakkan Islam sebagai dasar perjuangannya dan yakin dengan peranan agama Islam itulah menjadi pembimbing dan pendorong kepada ahli-ahlinya ke arah terbaik.

"Namun di sana, tidak bermakna semua anggotanya maksum tetapi sekurang-kurangnya dapat memagar, membantu dan membina agar tidak terlalu terdedah kepada maksiat dan mungkar.

"Dengan dasar itu, mereka dapat menjadi insan, pejuang dan ahli politik yang baik namun di sana seperti agama Islam sendiri di mana ada yang masih tidak mentaati Islam, secara umumnya ini keluar dari dasar," tegasnya lagi

Menyentuh tentang tajuk wacana, beliau berkata fitnah bersifat umum, ia boleh berlaku sama ada dalam dan luar parti politik dan di dalam masyarakat dan individu.

Ustas Nasrudin melahirkan rasa simpati kepada Khairy dan rakan-rakan yang sering menerima fitnah sesama mereka dalam usaha mendapat tempat dalam kedudukan politik mereka.

Tegasnya, rakyat negara sudah ingin kepada sistem politik berasaskan hujah, berhikmah, telus dan tulus serta pandangan berasas serta bernas dan bukan berhasrat menjatuhkan lawan begitu sahaja dengan fitnah.

Murky arms deal linked to international pattern of kickbacks A potentially explosive scandal in Malaysia over the billion-dollar purchase of French submarines, a deal engineered by then-Defense Minister Najib Tun Razak, has broken out of the domestic arena with the filing of a request to investigate bribery and kickbacks from the deal in a Paris court. Although the case has been contained for eight years in the cozy confines of Malaysia's courts and parliament, which are dominated by the ruling National Coalition, French lawyers William Bourdon, Renaud Semerdjian and Joseph Breham put an end to that when they filed it with Parisian prosecutors on behalf of the Malaysian human rights organization Suaram, which supports good-government causes. Judges in the Paris Prosecution Office have been probing a wide range of corruption charges involving similar submarine sales and the possibility of bribery and kickbacks to top officials in France, Pakistan and other countries. The Malaysian piece of the puzzle was added in two filings, on Dec. 4, 2009 and Feb. 23 this year. For two years, Parisian prosecutors, led by investigating judges Francoise Besset and Jean-Christophe Hullin, have been gingerly investigating allegations involving senior French political figures and the sales of submarines and other weaponry to governments all over the world. French news reports have said the prosecutors have backed away from some of the most serious charges out of concern for the political fallout. The allegations relate to one of France's biggest defense conglomerates, the state-owned shipbuilder DCN, which merged with the French electronics company Thales in 2005 to become a dominant force in the European defense industry. DCN's subsidiary Armaris is the manufacturer of Scorpene-class diesel submarines sold to India, Pakistan and Malaysia among other countries. All of the contracts, according to the lawyers acting for Suaram, a Malaysian human rights NGO, are said to be suspect. With Najib having moved on from the defense portfolio he held when the deal was put together in 2002 to become prime minister and head of the country's largest political party, the mess has the potential to become a major liability for the government and the United Malays National Organisation. Given the power of UMNO, it is unlikely the scandal would ever get any airing in a Malaysian court, which is presumably why Suaram reached out to French prosecutors. "The filings are very recent and have so far prompted a preliminary police inquiry on the financial aspects of the deal," said a Paris-based source familiar with France's defense establishment. "There isn't a formal investigation yet. The investigation will most likely use documents seized at DCN in the course of another investigation, focusing on bribes paid by DCN in Pakistan." The source said police have confined their inquiry to bribery allegations so far and have not looked into the 2006 murder of a Mongolian woman in Malaysia who was a translator on the deal for Najib and his friend, Abdul Razak Baginda, during a visit to Paris. There have been numerous deaths involving DCN defense sales in Taiwan and Pakistan. Prosecutors are suspicious that 11 French submarine engineers who were murdered in a 2002 bomb blast in Karachi – first thought to have been the work of Al Qaeda – were actually killed in retaliation for the fact that the French had reneged on millions of dollars in kickbacks to Pakistani military officers. The Malaysian allegations revolve around the payment of €114 million to a Malaysia-based company called Perimekar, for support services surrounding the sale of the submarines. Perimekar was wholly owned by another company, KS Ombak Laut Sdn Bhd, which in turn was controlled by Najib's best friend, Razak Baginda, whose wife Mazalinda, a lawyer and former magistrate, was the principal shareholder, according to the French lawyers. "Over the past years, serious cases have been investigated in France by judges involving DCN," lawyer Renaud Semerdjian told Asia Sentinel in a telephone interview. "This is not the first case of this kind that is being investigated. There are others in Pakistan and there are some issues about India. To a certain extent, every time weapons of any kind have been provided, suspicion of violation of the law may be very high." As defense minister from 2000 to 2008, Najib commissioned a huge military buildup to upgrade Malaysia's armed forces, including two submarines from Armaris and the lease of a third, a retired French Navy Agosta-class boat. There were also Sukhoi supersonic fighter jets from Russia and millions of dollars spent on coastal patrol boats. All have come under suspicion by opposition leaders in Malaysia's parliament but UMNO has stifled any investigation. Asked personally about the cases, Najib has responded angrily and refused to reply. Despite efforts to bury it, the case achieved considerably notoriety after the murder of Altantuya Shaariibuu, a 28-year-old Mongolian translator and Razak Baginda's jilted lover, who participated in negotiations over the purchase of the submarines. By her own admission in a letter found after her death, she was attempting to blackmail Razak Baginda for US$500,000. She was shot in October 2006 and her body was blown up with military explosives by two bodyguards attached to Najib's office after Razak Baginda went to Najib's chief of staff, Musa Safri, for help in keeping her away from him. Not long after being acquitted in November 2008 under questionable circumstances of participating in her murder, Razak Baginda left the country for England. The bodyguards were convicted but no motive was ever established for their actions despite a confession by one which was not allowed in court, but which said they would be paid a large sum of money to get rid of her. The submarine deal was never brought up in court during a months-long murder trial that was marked by prosecutors, defense attorneys and the judge working studiously to keep Najib's name out of the proceedings. A private detective hired by Razak Baginda to protect him from the furious Altantuya filed a statutory declaration after the trial indicating that Najib had actually been the victim's lover and had passed her on to Razak Baginda. The detective, P. Balasubramaniam, said later that he was unceremoniously run out of Kuala Lumpur. He eventually emerged from hiding in India to say he had been offered RM5 million (US$1.57 million) by a businessman close to Najib's wife to shut up and get out of town. He also said he had met Nazim Razak, Najib's younger brother, and was told to recant his testimony. In the current complaint in Paris, the issue revolves around what, if anything, Razak Baginda's Perimekar company did to deserve €114 million. Zainal Abidin, the deputy defense minister at the time of the sale, told parliament that Perimekar had received the amount – 11 percent of the sale price of the submarines – for "coordination and support services." The Paris filing alleges that there were neither support nor services. Perimekar was registered in 2001, a few months before the signing of the contracts for the sale, the Paris complaint states. The company, it said flatly, "did not have the financial resources to complete the contract." A review of the accounts in 2001 and 2002, the complaint said, "makes it an obvious fact that this corporation had absolutely no capacity, or legal means or financial ability and/or expertise to support such a contract." "None of the directors and shareholders of Perimekar have the slightest experience in the construction, maintenance or submarine logistics," the complaint adds. "Under the terms of the contract, €114 million were related to the different stages of construction of the submarines." The apparent consideration, supposedly on the part of Perimekar, "would be per diem and Malaysian crews and accommodation costs during their training. There is therefore no link between billing steps and stages of completion of the consideration." As Asia Sentinel reported on April 1, services for the subs are being performed by a well-connected firm called Boustead DCNS, a joint venture between BHIC Defence Technologies Sdn Bhd, a subsidiary of publicly-listed Boustead Heavy Industries Corp Bhd, and DCNS SA, a subsidiary of DCN. Boustead's Heavy Industries Division now includes Perimekar as an "associate of the Group. PSB is involved in the marketing, upgrading, maintenance and related services for the Malaysian maritime defence industry," according to Boustead's annual report. Originally Boustead told the Malaysian Stock Exchange that the service contract was for RM600 million (US$184.1 million) for six years, or US$30.68 million annually. However, the contract later ballooned to RM270 million per year. Boustead Holdings is partly owned by the government and has close connections with UMNO. "There are good grounds to believe that [Perimekar] was created with a single objective: arrange payment of the commission and allocate the amount between different beneficiaries including Malaysian public officials and or Malaysian or foreign intermediaries," the complaint states.

Majlis minta agihan insentif menyeluruh

KUALA LUMPUR: Gabungan Majlis Guru Besar Malaysia (GMGBM) meminta satu kajian dibuat Kementerian Pelajaran berhubung insentif diumum Perdana Menteri, Datuk Seri Najib Razak, kelmarin, kerana ia meminggirkan warga pendidik sekolah rendah.

Yang Dipertuanya, Roslan Madon, berkata kerajaan perlu mempertimbangkan insentif kepada guru besar dan guru di sekolah rendah serta Sekolah Kurang Murid (SKM).

"Nyata, kerajaan terlepas pandang warga pendidik di sekolah rendah, walhal alam persekolahan bermula di sekolah rendah. Kenapa jasa warga 7,900 pendidik sekolah rendah tidak diambil kira," katanya.

Sempena Hari Guru, kelmarin, Najib mengumumkan guru terbabit dalam pengajaran dan pembelajaran (PDP) berpeluang menikmati kenaikan pangkat hingga ke gred DG54 berbanding setakat gred DG48 sekarang, mulai 1 Januari depan, selain berpeluang mencapai Gred Khas C dan ke atas sebelum bersara.

Beliau juga mengumumkan guru kini diklasifikasi kepada empat kategori iaitu Guru Biasa, Guru Kanan, Guru Wibawa dan Guru Pendeta dengan mereka yang mencapai dua kategori tertinggi berpeluang mencapai sehingga gred DG54.

Selain itu, kerajaan bersetuju menaikkan gred jawatan semua Pengetua Sekolah Menengah gred DG48 ke DG52, manakala semua Guru Penolong Kanan (GPK) Sekolah Menengah dinaikkan dari DG44 ke DG48. Bagi GPK sekolah rendah kluster, mereka dinaikkan pangkat dari gred DGA32 ke DGA34.
Roslan berkata, GMGBM akan mengadakan pertemuan dengan Kementerian Pelajaran tidak lama lagi bagi meminta supaya guru besar dan guru sekolah rendah turut diberikan insentif bagi menaikkan semangat serta motivasi mereka.

Sementara itu, Kesatuan Perkhidmatan Perguruan Kebangsaan (NUTP) juga mahu mengadakan pertemuan dengan Najib dalam masa terdekat berhubung pemberian insentif itu.

Setiausaha Agungnya, Loke Yim Pheng, berkata ia bagi membincangkan tuntutan dikemukakan NUTP kepada kerajaan sebelum ini tetapi tidak dilaksanakan.

"Kami juga akan menyuarakan kekecewaan kami kerana insentif yang diberikan tidak membabitkan guru sekolah rendah dan menengah," katanya.

Di KUCHING, Jawatankuasa Bersama Kesatuan Persatuan Guru Malaysia (JBKPGM) menyifatkan insentif diumumkan kerajaan tidak adil kepada masyarakat guru keseluruhannya kerana ia hanya membabitkan guru berijazah di sekolah menengah.

Naib Pengerusi JBKPGM, William Ghani Bina, berkata insentif itu langsung tidak membabitkan guru bertugas di Kementerian Pelajaran, Jabatan Pelajaran Negeri, Pejabat Pelajaran Daerah dan 160,000 guru yang mengajar di 7,800 sekolah rendah.

Oleh itu, JBKPGM yang mengadakan Mesyuarat Tergempar di Kuching, malam kelmarin, memutuskan meminta Kementerian Pelajaran mengkaji semula kaedah baru kenaikan pangkat guru yang diumumkan kelmarin.

Ghani berkata, JBKPGM juga berkata beberapa permintaan dikemukakan mereka terlepas pandang. Antaranya, elaun khas untuk Pengetua sebanyak RM600 dan Guru Besar RM500 kerana penyandang jawatan itu hanya menerima RM150 dan RM100 sekarang.

"Elaun yang mereka terima selaku ketua di sekolah terlalu rendah berbanding dengan elaun guru dilantik sebagai warden asrama iaitu RM280 untuk Ketua Warden dan RM240 bagi Guru Warden, selain RM250 untuk Guru Pendidikan Khas," katanya.

SEMPORNA: As a precondition for the 13th general election, Umno vice-president Datuk Seri Mohd Shafie Apdal has rallied the Malays and bumiputeras to emulate the fighting spirit and unity demonstrated by earlier generations against the colonialists.

He noted that such fighting spirit and unity at that time had made possible, the country's independence and its current development.

Mohd Shafie said the unity among past leaders had helped thwart attempts by the colonialists to form the Malayan Union which the latter had hoped, would banish the Malay Rulers.

"We want the Malays and bumiputeras to be united as it is a prerequisite for the coming election. We need party members in all divisions to be as one.

"We want to make sure that Umno wins 100 per cent in all areas," he told reporters after launching the Semporna Umno Division Delegates Meeting here today.

On Umno members who had not registered as voters, Mohd Shafie, who is also rural and regional development minister, advised them to do so as every vote counted in ensuring Barisan Nasional continued to rule. -- BERNAMA

KUALA LUMPUR: Prime Minister Datuk Seri Najib Razak says the country is willing to send peacekeepers to help "de-escalate tension" in Bahrain while backing Saudi Arabia's role in resolving regional unrest.

Bahraini authorities in the kingdom ruled by a Sunni dynasty have attempted to curb violent protests in recent months inspired by uprisings that toppled Egypt's and Tunisia's presidents.

"Malaysia stands ready to contribute peacekeepers to the Kingdom of Bahrain, if invited to do so by the Bahraini leadership," Najib said in a statement on Friday following a meeting with Saudi Arabian monarch King Abdullah in Riyadh.

"Malaysia will consider it a great honour to offer assistance in this noble effort."

Najib said Malaysia, a Sunni Muslim-majority nation, supported the national dialogue process launched by Crown Prince Salman Hamad al-Khalifa in a bid to "de-escalate tension in the country".

On March 16, security forces drove mostly Shia protesters out of central Manama's Pearl Square and demolished their camp after King Hamad declared a state of emergency. The king also called in Saudi-led Gulf troops to boost his security force.

Bahrain authorities said 24 people, including four policemen, were killed in the unrest with the kingdom coming under strong criticism from international human rights organisations for its heavy-handed crackdown. -- AFP

Shazryl takes oath

KUALA LUMPUR: Businessman Datuk Shazryl Eskay Abdullah took a religious oath (sumpah laknat) that opposition leader Datuk Seri Anwar Ibrahim was the man in the sex video.

Flanked by former Malacca chief minister Tan Sri Abdul Rahim Thamby Chik and former Perkasa treasurer-general Datuk Shuaib Lazim, Shazryl also swore that he was in the video that was screened to selected journalists on March 21.

The other two, however, did not take the oath.

"On April 29, 2011, I, Shazryl Eskay Abdullah, in the name of Allah, swear that Datuk Seri Anwar Ibrahim and I were in the video on Feb 21, 2011 and Anwar is the man in the video.

"If what I said is not true, then Allah may curse me," said Shazryl, while holding a Quran in front of deputy imam Ezhan Shahril who acted as a witness.

The oath was taken at Masjid Amru Al-As at 4.15pm yesterday amid a heavy police presence.

Soon after the rite ended, the trio -- who appeared to be wearing bullet-proof vests underneath their baju melayu -- were whisked away without speaking to reporters.

A scuffle later broke out when the police tried to shield the trio from Parti Keadilan Rakyat supporters.

Earlier, there was a commotion in in the mosque when PKR supporters led by its youth chief Shamsul Iskandar Md Akin anticipated Shazryl's arrival after Friday prayers.

Describing the act as "unIslamic", Shamsul insisted that the trio and Federal Territory Islamic Department (Jawi) officials who were also present refer to Qazaf instead.

Qazaf is an Islamic ordinance of false accusations that could lead to punishment against the complainants if the individuals accused are found to be innocent.

Shazryl had previously challenged Anwar, the PKR de facto leader, to join him in taking the oath in order to prove his innocence.

Anwar, however, ignored the request and was not present during the ceremony.

Meanwhile, PKR vice-president Tian Chua described the act as "insulting to the religion".

"Not only does this insult the religion, but it also ignores the rule of law," said the Batu member of parliament.

PETALING JAYA: Pelawak Bob Lokman, 47, akhirnya membuat keputusan muktamad untuk bersara sebagai seorang pelakon selepas membuat keputusan untuk terlibat dengan aktiviti dakwah selain menjadi ahli PAS.

Bob atau nama sebenarnya Mohd Hakim Lokman berkata, dia sudah tidak mempercayai dunia hiburan yang dianggapnya sebagai hipokrit selain terdapat unsur-unsur yang tidak baik di dalamnya.

"Saya membuat keputusan untuk bersara kerana mendapati selama berkecimpung dalam dunia seni, banyak perkara yang tidak elok berlaku dalam bidang itu.

"Lagipun saya merasakan sekarang tibalah masanya untuk saya beralih menjadi seorang pendakwah," katanya kepada mStar Online, di sini, Rabu.

Bob yang pernah popular dengan lirik ciptaannya, Issabella nyanyian kumpulan Search memberitahu, dia tidak menyesal dengan keputusan tersebut walaupun rezekinya sebagai pendakwah tidak semewah berbanding ketika dia menjadi artis dahulu.

Bagaimanapun Bob yang mempunyai masalah penyakit Pankreas itu reda dengan hal itu demi mendapatkan hidayah dan berkat di dunia dan akhirat nanti.

Tambahnya, sejak 19 Februari lalu, dia kini lebih selesa berdakwah dan sekurang-kurangnya memberi ceramah sebanyak tiga kali sehari.

"Sebelum meninggal dunia, lebih baik saya melakukan amal jariah sebanyak yang mungkin. Sekurang-kurangnya, saya tidak mati dalam keadaan yang leka dan melakukan perkara yang sia-sia.

"Sebenarnya industri hiburan kita boleh menjadi lebih elok jika kita ubah sistemnya kerana Islam membenarkan umatnya melakukan apa sahaja tetapi dengan syarat-syarat tertentu," tuturnya.

Kata Bob, sejak bergelar seorang pendakwah, dia jarang bertemu dengan rakan-rakan artisnya melainkan mereka yang mendengar ceramahnya atau bertemu dia di masjid antaranya ialah Cico, Abu Bakar Omar, Wahid Senario, Adam AF dan Ahmad Fedtri Yahya.

ORANG Cina telah bersatu. Keputusan Pilihan Raya Negeri Sarawak telah membuktikannya. Malah, sebenarnya orang Cina telah pun bersatu sejak dulu lagi.

Perkembangan politik muaasir (kontemporari), selepas era-Mahathirisme dan semasa era-Abdullahisme telah membuktikan ikatan orang Cina lebih utuh dan berpadu. Hubungan kekitaan, kekeluargaan serta brotherhood dan ukhwah orang Cina lebih erat, tanpa boleh ditandingi oleh mana-mana kaum di atas muka bumi Malaysia ini.

Walaupun antara mereka berlainan haluan politik, tapi apabila sampai masa menentukan arah untung nasib kaum Cina – mereka akan bersatu atas pangkahan undi yang sama.

Dalam ekonomi, mereka membantu antara satu sama lain. Dari sekecil-kecil ekonomis kepadalah yang sebesar-besarnya, mereka akan tolong-menolong antara satu sama lain.

Budaya telah berjaya menyatupadukan orang Cina. Dalam masyarakat Cina tiada istilah bidaah yang boleh memesongkan mereka daripada soal budaya dan adat resam bangsa. Bahasa Cina diangkat tinggi, malah ada yang kata orang Cina yang tidak boleh membaca Cina pun akan turut membantu membeli akhbar Cina. Maka itu, akhbar Sin Chew Jit Poh – suara keramat orang Cina, menjadi antara akhbar yang paling tinggi edaran dan keuntungannya di Malaysia.

Sekolah Cina terus dijadikan sebagai cagaran politik utama – yang tidak boleh dikompromi sama sekali.

Pendek kata, orang Cina sebenarnya amat beruntung sekali berada di bumi Malaysia ini. Mereka telah menguasai segala-galanya. Sepuluh teratas orang mereka adalah bilionaire Malaysia. Sebahagian besar kedai yang ada di atas muka bumi Malaysia ini milik mereka. Hampir semua pelajar yang belajar di universiti swasta dan IPTS ternama dan mahal-mahal di negara ini rata-ratanya orang mereka.

Saya telah nyatakan perkara itu dalam Cuit bertajuk Apa lagi orang Cina mahu? tahun lepas. Tulisan itu dipetik sepenuhnya oleh akhbar Straits Times Singapura dan surat pembaca yang saya terima dari republik itu menyokong penuh tulisan itu.

Apa yang saya katakan ini adalah hakikat atau fakta.

Hanya kuasa mutlak politik yang belum dikuasai sepenuh oleh orang Cina, yang lain semua sudah. Kini DAP membawa slogan yang cukup hebat di kalangan masyarakat mereka iaitu Undi untuk Ubah, Enough is Enough (Cukuplah) dan Selamatkan Malaysia.

Slogan itu sebenarnya bukan ditujukan kepada orang lain, tapi khususnya kepada orang Cina. Terpapar megah di dada baju penyokong dan calon DAP dalam pilihan raya Sarawak supaya diubah kepimpinan Melayu Malaysia ini.

Terus terang saya katakan, saya amat menyanjungi orang Cina. Mereka mempunyai matlamat dan masa depan yang cukup jelas. Walaupun tindakan itu berbau politik atau bukan, soalnya mereka cukup bersatu. Politik digunakan sebaik-baik mungkin untuk menyatupadukan kaum itu.

Kita jangan salahkan DAP. Apa yang DAP lakukan itu amat betul untuk masa depan kaumnya. Jika Pas dipergunakan oleh DAP untuk memecahkan bangsanya sendiri, itulah operatif licik DAP.

DAP telah berjaya menjadi parti Cina yang telah menyatupadukan orang Cina. MCA gagal dan SUPP pun gagal. Itu hakikat atas kertas. Malah seorang sahabat saya berbangsa Cina, pengarang sebuah akhbar ternama bersetuju bahawa orang Cina kini ke arah menyokong pembangkang. Pilihan Raya Umum Ke-13 akan digunakan sepenuhnya untuk menyatukan kuasa mereka.

Sebaliknya apa yang orang Melayu buat? Tiada apa-apa. Mereka ialah satu bangsa yang cukup selesa, komplesen, alpa dan tidak peduli. Malah pemikiran mereka cukup bercelaru.

Apa yang harus UMNO lakukan? UMNO harus berfikiran seperti DAPkah?

Pandangan saya, apa yang UMNO harus lakukan sekarang, di masa yang amat terdesak sekarang, ialah melancarkan gelombang perpaduan bangsa – 1Melayu, 1Bumi.

Lancarkan segera 1Melayu, 1Bumi dalam lingkungan UMNO dan parti-parti Melayu yang lain.

Jika Pas degil dan tidak mahu ikut serta, gabungkan dengan puluhan NGO-NGO Melayu yang kini tumbuh bagaikan cendawan di atas bumi Malaysia ini. Perlu diingat NGO-NGO itu wujud kerana mereka dahagakan wadah perjuangan untung nasib bangsa semakin ditinggalkan. UMNO harus tarik pertubuhan sukarela ini ke hadapan dan menjadi juara semula dalam soal ini.

Persetankan Pas yang ternyata telah menggadaikan perjuangan bangsa Melayu untuk kepentingan politik totok mereka. Hairan sungguh, para penyokong Pas akan menjadi lebih kuah daripada sudu semasa berkempen, dan mereka tidak pernah sedar bahawa secara senyap-senyap DAP cukup strategik mempermainkan mereka.

Saya kira, sekiranya lima kerusi Pas di Sarawak itu ditandingkan di kawasan Cina sudah pasti mereka akan menang dan ada wakil dalam dewan undangan negeri. Tapi DAP telah mempermainkan mereka. Pas diletakkan di kawasan kaum bumiputera, bagi membolehkan kaum bumiputera terus berpecah. Pas seperti biasa, tidak sedar semua itu.

Dalam usaha meniupkan gelombang 1Melayu, 1Bumi, tidak salah 1Malaysia diteruskan kerana ia adalah dasar jangka panjang negara. Parti komponen Cina dalam BN pun tidak akan marah jika UMNO melancarkan gagasan 1Melayu, 1Bumi kerana bagi mereka orang Cina telah pun bersatu.

Tidak salah bagi orang Melayu melancarkan seruan 1Melayu, 1Bumi kerana orang Melayu sendiri belum bersatu.

Dalam tulisan-tulisan saya sebelum ini, saya ada mengatakan orang Melayu berpecah kepada enam golongan. Melayu UMNO, Melayu Pas, Melayu PKR, Melayu DAP, Melayu Liberal dan Melayu Atas Pagar.

Orang Melayu cukup berpecah. Orang Cina tidak akan marah sekiranya orang Melayu bersatu kembali. Mungkin DAPlah yang tidak selesa kerana matlamat mereka untuk memecah-belahkan lagi orang Melayu akan gagal.

Bagi DAP, selagi konsep Malaysia Malaysian mereka tidak berlaku, selagi itu mereka akan berusaha keras untuk menjayakannya.

UMNO harus meniupkan gagasan 1Melayu, 1Bumi ini segera. Orang Melayu harus disatukan segera bagi memastikan mereka menguasai semula politik yang semakin terhakis daripada tangan mereka.

Walaupun Melayu berpecah, namun ada lagi suara-suara segelintir yang amat sayangkan bangsa. Seorang sahabat umpamanya, menghantar SMS semasa tulisan ini ditulis berbunyi: “Tolong tulis...BN jangan lagi bagi kawasan majoriti Melayu kepada wakil MCA, Gerakan dalam PRU akan datang... cukup sudah pengorbanan UMNO yang dibalas dengan tuba. MCA dan Gerakan WAJIB akur kerana kalau mereka kalah dengan DAP, wakil mereka tak perlu dilantik dalam kerajaan...”

Itu ialah suara marah. Orang Melayu marah. Tapi kita harus rasional. Susun semula barisan dan gelombang satukan orang Melayu.

Saya bercakap bagi pihak bangsa saya. Gagasan inilah yang turut dimainkan oleh sahabat saya, saudara Ridhuan Tee Abdullah, seorang mualaf Cina yang cukup kental jiwa ultra-Melayunya. Orang Cina amat tidak menggemari beliau di atas semangat assabiyah Melayu beliau itu.

Namun bagi Ridhuan, dan orang Melayu yang lain, mereka amat khuatir dengan perkembangan mutakhir yang berlaku di negara ini sekarang.

Namun, penghargaan harus diberi kepada kaum bumiputera Sarawak yang telah melaksanakan tanggungjawab mereka dengan begitu betul sekali.

Saya angkat topi kepada kaum bumiputera Sarawak yang dilihat lebih matang daripada orang Melayu di Semenanjung. Sekiranya mereka tidak bersatu dalam pilihan raya 16 April lalu, maka Sarawak sudah tentu akan jatuh ke tangan orang lain.

Orang bumiputera Sarawak telah memberi satu petunjuk yang amat berharga supaya diikuti oleh kaum Melayu di Semenanjung.

Namun, orang Melayu Semenanjung berpecah enam. Mereka masih lagi berpecah enam.

Oleh itu menjadi kewajipan UMNO; atas nama pejuang-pejuangnya yang terdahulu; dan sebagai parti induk orang Melayu; lancarkan segera slogan 1Melayu, 1Bumi bagi menggerakkan semula gelombang kebangsaan bangsa itu.

Melayu harus dan wajib disatukan kembali sebagaimana kita mahu satukan orang Malaysia di bawah semangat 1Malaysia. Tiada makna adanya 1Malaysia, jika orang Melayu sendiri pun berpecah.

Kini terletak dalam tangan UMNO untuk menentukan hidup atau mati bangsa ini.

Orang Cina sudah ada 1Cina dalam erti kata tersendiri. Orang Melayu pun perlu ada 1Melayu, 1Bumi. Ayuh gerakkan!

KUALA LUMPUR, 17 Feb — Bekas ketua polis negara Tun Mohd Haniff Omar hari ini mengakui beliau adalah individu yang menghalang cadangan kerajaan yang mahu memansuhkan Akta Keselamatan Dalam Negeri (ISA).

Haniff yang berkhidmat sebagai Ketua Polis Negara selama 20 tahun sehingga 1994 berkata, bekas perdana menteri Tun Dr Mahathir Mohamad dan bekas timbalan perdana menteri Datuk Seri Anwar Ibrahim pernah mencadangkan supaya ISA dimansuhkan.

"Anwar kata kita harus mansuhkan ISA, Dr Mahathir kata OK.

"Tapi saya minta mereka untuk mempertimbangkan cadangan itu dengan berkata ia hanya membabitkan soal keselamatan negara," katanya pada Forum Cabaran Semasa Demokrasi dan Perlembagaan Ke Arah Pencapaian Wawasan 2020 di sini.

Jelas Haniff, Dr Mahathir konsisten dalam usaha untuk memansuhkan ISA yang telah menahan ramai individu tanpa dihadapkan di mahkamah.

"Bila beliau (Dr Mahathir) jadi perdana menteri, (Tun) Musa Hitam beritahu saya agar tidak menggunakan ISA kerana Dr Mahathir tidak menyukainya," katanya.

Dalam program yang sama, Dr Mahathir berkata beliau sebenarnya mahu memansuhkan ISA ketika memegang tampuk pemerintahan negara selama 22 tahun.

Bagaimanapun, menurut Dr Mahathir, usaha itu gagal kerana pihak polis menolak cadangan tersebut.

Sebelum ini, Dr Mahahir menyalahkan polis yang ekoran penangkapan besar-besaran di bawah ISA pada 1987 yang turut membawa kepada penahanan lebih 100 orang termasuk Penasihat DAP Lim Kit Siang dan anaknya Lim Guan Eng yang kini Ketua Menteri Pulau Pinang.

Sementara itu, Dr Chandra Muzaffar yang juga merupakan bekas tahanan ISA mempertahankan tindakan Dr Mahathir dalam Ops Lalang dengan berkata, ia tidak ada kaitan dengan negarawan itu.

Menurut Chandra, operasi tersebut adalah tindakan dilakukan polis dan bukannya arahan Dr Mahathir.

"Berdasarkan pengalaman saya, saya ditahan di Pulau Pinang dan dibawa ke Kuala Lumpur di mana saya berjumpa Tun Haniff, semasa saya berjumpa Tun Haniff beliau berkata ia adalah operasi polis dan beliau begitu konsisten.

"Penangkapan selama 60 hari itu adalah operasi polis," tegas beliau yang juga meminta supaya ISA dimansuhkan.

Chandra, seorang ahli akademik dan Presiden JUST, pernah berada dalam Parti Keadilan Rakyat (PKR) yang Anwar merupakan ketua umumnya sekarang.

While the whole nation was in great shock over the 'sudden death' (as described by police earlier…) of DAP aide Mr.Teoh Beng Hock, let us recall a similar case happened in Kuching few years back that is the death case of a state govt officer the late Mr. Rumie Azzan Mahlie (Sept 17, 2004) in which the whole case deemed to be inconclusive whether it was from foul play or attempted suicide. It is simply that no witness that saw the whole incident, of how, why, basically a dead end case with open verdict. This poor soul young man died for no reason whatsoever, beside other rumours or speculation of his work pressure or by whom he was pressured as his department dealing with many big Sarawak corporations that require stringent environmental report before any big development shall fit for approvals, such as logging projects and the fact that his department indeed within the same building with Sarawak Timber Association (STA) simply gel up the whole conspiracy theory of possible fall-out vested interest between enforcement agency vs timber companies.

Now compare to this poor chap Mr. Teoh Beng Hock facing almost similar incident, only with different side of the field taking pressure as well. While Mr. Rumie was probably facing timber goons, Mr.Teoh was facing MACC. While Mr. Rumie could behunting(perhaps environmental assessments) on timber goons, Mr. Teoh was hunted(perhaps on state funds abuse allegations) by MACC. But both could resist hardly the pressure to bow on whatever evil request they won't willing to do or accept. So both ended up dead, leaving trails of unsolved mysteries. Even more awkward by the look of the photo in which there was not much blood from a body that supposedly fell from a great height, at least a 10-storey high building while in Mr.Rumie's case it was a pool of blood also from almost similar height. Can blood be 'evaporated' anyway? The next question is, would Mr.Teoh's case end up as inconclusive as Mr.Rumie's case while the perpetrator walk out scot-free? Could anyone simply died for fun whatsoever in this BolehLand? Enjoying death eh? Just take your time and see how Mr.Rumie's case would lead a similar unsolved mystery plus a possible conspiracy theory path for Mr.Teoh's case as well.

High Court rejects bid to revise coroner's verdict in Rumie's death

KUCHING (June 22, 2007): The High Court today rejected an application to revise the coroner's findings in the death of Sarawak Department of Environment (DOE) investigating officer Rumie Azzan Mahlie three years ago. In making the ruling, Justice David Wong Dak Wah said he was satisfied the inquest into the death of the 31-year-old officer had come to a conclusion based on true facts by the coroner's open verdict that there was no evidence he had committed suicide or was murdered.

According to reports, Rumie fell to his death from the ninth floor of a building housing the department's office in Pending here on Sept 17, 2004.

Wong also said it was beyond the jurisdiction of the High Court to direct the public prosecutor to reopen the case with a more competent investigation team, as requested by Rumie's family to clear his name, claiming that he was murdered and that his death was due to foul play.

However, he ruled that counsel Dominique Ng, who holds a watching brief for Rumie's family, had the locus standi (legal standing) to apply for a judicial review on their behalf because under normal circumstances, only the public prosecutor who played the role of an examiner in an inquest had the locus standi to initiate it, reports Bernama today.

Present in court were Rumie's family members, including his widow Suraidi Abdullazid, sons Syafi, nine, and Hafeez, six, who were clearly disappointed with today's ruling.

The inquest, which was held after Rumie's family asked the police to reopen investigation into the case, had found that his death was due to a fall from a height as there was insufficient evidence to help identify the root cause of his death.

Speaking to reporters later, Ng said the family's consolation was that the coroner had settled for the decision that there was no presumption for Rumie to commit suicide due to work pressure, which would have been against his Islamic beliefs.

In view of the High Court ruling, he urged the public prosecutor to review the findings of the lower court, presided over by coroner Tengku Sharizan Tuan Lah.

A total of 31 witnesses testified in the 21-day inquest which began last Oct 24, including Rumie's father, Mahlie Jolihi, Suraidi, investigating officer Sub-Insp Mohammad Bujang and former Sarawak DOE director Dr Abdul Rahman Awang.

INQUEST INTO THE DEATH OF RUMIE BIN MAHLIE
RESPONDENT

BEFORE THE HONOURABLE JUSTICE
TUAN DAVID WONG DAK WAH

IN OPEN COURT

R U L I N G

Brief background:

The learned Magistrate was directed by the Public Prosecutor on 6th July 2005 under s. 339 of the CPC, to hold an inquiry into the cause of, and the circumstances connected with, the death of Rumie Azzan B Mahlie (deceased). Learned Magistrate held an inquiry from 24th October 2005 and his terms of reference were to find out:-

(1) When did the deceased die?
(2) Where did the deceased die?
(3) How did the deceased die?
(4) In what manner the deceased died?
(5) Whether any person is criminally concerned with the death?

The learned Magistrate delivered his verdict on the 6th October 2006 (verdict) which concluded as follows:-

"I am therefore of the opinion that the deceased's death occurred between 10.50 – 10.59 am on the 17/9/2004. It occurred on the ground floor of the STA building. The deceased died due to multiple injuries within his body which affect his main internal organs secondary from fall from height. With regard to the manner in which the deceased came to his death, the court cannot determine based on the depositions before it whether his death resulted in any way from, or was accelerated by any unlawful act or omission on the part of any person. However, this court will leave it to the police to conduct further investigation, if any."

The learned Magistrate delivered what is called an "open verdict". The family of the deceased was not happy with the verdict and has made an application for revision through their solicitor, Mr. Dominque Ng (Mr. Ng), under s 341A read with the provisions of Chapter XXXI of the Criminal Procedure Code ('CPC') for the High Court to examine the record of the inquiry into the death of the deceased for the purpose of satisfying the High Court as to the correctness, legality or propriety of the finding of learned Magistrate recorded in his verdict. In his submission, Mr. Ng wanted the court to revise the verdict to say as follows:-

1. That Rumie never fell to his death from the Window of Operations Room located at the 9th level of the STA building;
2. That Rumie did not die by committing suicide.

Mr. Ng also urges the court to request for the prosecution to conduct further investigations into Rumie's death and to reopen the case with another more competent investigation officer.

Jurisdiction of the court

At the commencement of this hearing, I asked learned Senior Federal Counsel and Mr. Ng whether this Court has the jurisdiction to hear this revision bearing in mind that this application is by the family of the deceased and not by the learned Senior Federal Counsel. This issue had been dealt with in the cases of Re Derek Selby Decd [1971] 2 MLJ 277 and Pendakwa Raya v Shanmugam & 5 Others (2002) 1 LNS 160 which held that High Courts do have the jurisdiction to revise any finding of a Magistrate sitting in an inquest proceeding.

I wanted to revisit this principle of law as it may be argued that application for revision can only be done at the request of the prosecution as after all any inquest into a death can only be done through the sanction of the Public Prosecutor. This is clear from section 339 Criminal Procedure Code which reads as follows:-

339. Power of Public Prosecutor to require inquiry to be held.

(1) The Public Prosecutor may at any time direct a Magistrate to hold an inquiry under this Chapter into the cause of, and the circumstances connected with, any death such as is referred to in sections 329 and 334, and the Magistrate to whom such direction is given shall then proceed to hold an inquiry and shall record his finding as to the cause of death and also as to any of the circumstances connected with it with regard to which the Public Prosecutor may have directed him to make inquiry.

(2) When the proceedings at any inquiry under this Chapter have been closed and it appears to the Public Prosecutor that further investigation is necessary, the Public Prosecutor may direct the Magistrate to reopen the inquiry and to make further investigation, and thereupon the Magistrate shall have full power to reopen the inquiry and make further investigation and thereafter to proceed in the same manner as if the proceedings at the inquiry had not been closed: Provided that this subsection shall not apply to any inquiry at which a finding of murder or culpable homicide not amounting to murder has been returned against any person.

(3) When giving any direction under this section the Public Prosecutor may also direct whether the body shall or shall not be exhumed.

(4) All directions given under this section shall be complied with by the Magistrate to whom they are addressed without unnecessary delay.

However having reread both the judgments of Sharma J and Suriyadi Halim Omar J in the just quoted cases I wish to state that I agree with their conclusions though reluctantly that the High Court has the jurisdiction to revise the findings of a Magistrate in an inquest provided that there has been a miscarriage of justice. I say reluctantly because in an inquest into death, there is no judgment by the Magistrate as in a trial which has a definitive finding of fault and subject to an appeal. It is only an expression of a non binding opinion of a proceeding where there is no accusation against any party. If of course the Magistrate had erred in his opinion, it is duty bound on the Public Prosecution to seek redress in court by way of a revision. The family of the deceased is fully entitled to write to the Public Prosecutor to express their reservations about the verdict and if there are merits, the Public Prosecutor is then duty bound to seek a revision in court as he is under the Federal Constitution the guardian of public interests. This argument of course was not considered by both Sharma J and Suriyadi Halim Omar J. Be that as it may, I cannot find any cogent reason to limit the plain English meaning of section 341A (Power to revise) which incorporates the power of revision set out in Chapter XXXI of the Criminal Procedure Code which consists of the following sections:

323. Powers to call for records of subordinate Courts.

(1) A Judge may call for and examine the record of any proceeding before any subordinate Criminal Court for the purpose of satisfying himself as to the correctness, legality or propriety of any finding, sentence or order
recorded or passed, and as to the regularity of any proceedings of that subordinate Court.

(2)Orders made under sections 97 and 98 are not proceedings within the meaning of this section.

I shall now deal with substantive matter of this application. Should the findings of the Magistrate be revised?

To recap, Mr. Ng wants this court to change the learned Magistrate's finding to reflect that the deceased did not commit suicide and did not fall from the 9th floor.

It is opportune now to restate the law on the duty of the learned Magistrate and this is succinctly stated by Sulong Matjeraie J in the recent case of In Re Anthony Chang Kim Fook, Deceased [2007] 2 CLJ 362 at page 265-266 as follows:-

"Section 337 of the CPC serves as the terms of reference within which the Coroner conducts the Inquest into the death of the deceased. As such the Coroner cannot act outside the perimeter of the said terms of reference. It must be borne in mind that in an inquest, there are no parties, there is no indictment, there is no prosecution, there is no defence and there is no trial. It is simply an attempt to establish facts. It is an inquisitorial process, a process of investigation quite unlike a trial where the prosecutor accuses and the accused defends, the Judge holding the balance or the ring, whichever metaphor one chooses to use, see R v South London Coroner; ex parte Thompson [1982] 126 SJ 625 DC.

In another English case of R v Huntbash; ex parte Lockley [1944] KB 606, Viscount Caldecote CJ adds:

"…It is not probability; however which determines verdicts, but proved facts, and, if facts which justify a specific verdict are not proved at an inquest, there is no alternative but to return an open verdict…" This is because a Coroner is bound by evidence and can only find facts which are proved in evidence and are not as a result of guesswork which is "certainly out", per Suriyadi J (now JCA) in Public Prosecutor v Shanmugam [2002] 6MLJ 562. The function of a Magistrate in holding an inquiry under s. 337 is only to inquire when, where, how and after what manner the deceased came to his death and also whether any person is criminally concerned in the cause of death and without more."

In Re Loh Kah Kheng (deceased) Mohamed Dzaiddin J (as he then was) (1990) stated:

"It must be remembered that the function of a Magistrate holding an inquiry is to inquire when, where and how and after what manner the deceased came by his death and also whether any person is criminally concerned in the cause of such death (section 337). The cause of death is not defined under section 328 to include not only the apparent cause of death as ascertained by the inspection or post mortem examination of the deceased but all matters necessary to enable an opinion to be formed as to the manner in which the deceased came by his death and as to whether his death resulted in any way from, or was accelerated by any unlawful act or omission on the part of any person"

The principle distilled from the above cases is clear and that is the learned Magistrate can only made a definite finding based on proved facts produced and not on mere conjectures. So applying that principle of law, I shall now look at the evidences to determine whether or not I should accede to the request of Mr. Ng.

Mr. Ng submitted that there are no evidences to say that the deceased fell from the window of the operations room of level 9 of the STA Building. On this, that is what the learned Magistrate said in his finding at page 15 which I now reproduce:-

"In view of the above, I am of the opinion that the deceased had died by falling from height. But the court cannot decide whether he fell from the operation room (on the 9th floor) since the evidence is not conclusive. This is based on the following reasons:

1. The fact that the window in the operation room was open is not conclusive evidence that shows that he jumps from there.

2. The finding of the shoe mark in that room also cannot be said to have indicated that the deceased went into the room and jump through its window. This is because the shoe mark was never sent to the chemist department for testing nor was it ever compared by the I/O to the shoe of the deceased.

3. No finger print was taken by the police on the alleged window where the deceased was alleged to have fallen which is vital to determine whether the deceased fell from that window.

4. No witness testified in the course of this inquest that they did see the deceased went into the operation room during that particular time.

5. The fact that the room was messy is not a strong conclusion that the deceased went in.

From that finding, one can see clearly that the learned Magistrate found no conclusive evidence to say that the deceased felt from level 9 operations room of Wisma STA and as such cannot make any finding. But that does not mean the learned Magistrate was in a position to say that the deceased did not fall from the level 9 operations room as there are some evidences but not conclusive enough to say the deceased may have fallen from there. There are also evidences to the effect that no one saw the deceased leaving level 9's main door. Furthermore Dr Ahmad Toha (deponent 7) had testified that the injuries suffered by the deceased could only be from falling from a high place and had ruled out from the possibility of the deceased falling off from the 2nd or 3rd floor of Wisma STA. With those evidences before the learned Magistrate it is my view that the he was correct in not coming into any firm conclusion as to where the deceased felt from. Hence I find that there is no merit in Mr. Ng's submission on this point.

I come now to Mr. Ng's second request and that is to revise the learned Magistrate's finding to say that the deceased did not commit suicide. On this point Mr. Ng submitted that the deceased's behaviour prior to his death was not consistent to a person who would commit suicide. This is set out at page 8 of his submission. The relevant part of the learned Magistrate's finding is set out earlier in my judgment. One can see from that conclusion that the learned Magistrate handed down an open verdict on the ground that there were no proved evidence to say whether the deceased had committed suicide or died by unlawful means on the part of any person. Sharma J in Re Derek Selby Decd [1971] 2 MLJ 277 dealt with a situation similar to the present case and this is what the learned Judge said:

"There was no evidence of any plan or desire on the part of Mr. Selby to commit suicide. All that had been proved was that it was not impossible that the deceased had committed suicide. If it could have been shown that he actually had an intention to commit suicide it would be more probable that he in fact did commit it than if he had no such intention A person may have an opportunity to commit suicide but that does not mean that he committed it. There was no evidence that the deceased had at any time shown any intention to commit suicide (a man does not always carry his intentions into effect!). If it could be shown that during the week before his death the deceased actually attempted to kill himself and was prevented from doing so, it might have afforded some evidence that he had a tendency to commit suicide and might have made a second attempt. If, however, the evidence is not sufficient to come to a definite finding as to the cause of death an open verdict should be recorded. In R v Huntbash, ex parte Lockley [1944] KB 606 at p 608 Viscount Caldecote C.J. said:

"Objection is taken to the finding of the coroner on the ground that there was no evidence to support it, and that is the only point in this case. There is no aspersion on or criticism of the coroner's action, except the criticism to which everyone who sits in a court of justice is exposed, namely that a mistake has been made. It is clear that the coroner sought to discharge his duties with diligence and care, and in accordance with the law. … I am driven to the conclusion that there was nothing in that evidence on which it could properly be said that there was any evidence of suicide. I am satisfied that, if the coroner had been sitting with a jury and had given a proper direction to them, he would have told them: 'Whatever you may guess at, there is no basis of proved fact on which you can return any verdict other than an open verdict.' Section 3 of the Coroners Act, 1887, limits the duties of a jury to acting on evidence which establishes facts and not merely gives rise to surmises. Sub-section (3) of s. 4 is in these terms: 'After viewing the body and hearing the evidence the jury shall give their verdict and certify it by an inquisition in writing, setting forth, so far as such particulars have been proved to them, who the deceased was, and how, when, and where the deceased came by his death.' The words 'so far as such particulars have been proved to them' seem to emphasize the duty of the jury or of the coroner to confine themselves or himself to finding such particulars as have been proved by evidence. Here the coroner appears to have been attracted by the theory, which remained only a theory to the end of the inquest, that Lockley had deliberately made up his mind to escape for ever from grievances under which he was suffering. Passages in his affidavit illustrate how much he was basing his verdict on guesswork instead of on particulars which had been proved in evidence. The conclusions stated in those passages are nothing more than the expression of a theory which is attractive in its probability. It is not probability, however, which determines verdicts, but proved facts, and, if facts which justify a specific verdict are not proved at an inquest, there is no alternative but to return an open verdict…………..…………..The coroner will confine himself to establishing facts so far as he can by evidence and then give a verdict which is supported by the facts which have been proved." The law is that suicide is not to be presumed. It was for the above reasons that the finding of the learned magistrate was set aside and his verdict of suicide quashed by me and I substituted an open verdict instead." (emphasis added)

Similarly here, if I were to revise the learned Magistrate's finding to say that the deceased did not commit suicide I would be basing it on mere conjecture. There is no evidence before the learned Magistrate to conclusively say how the deceased died. Furthermore the allegations in P13 (the letter alleging that the deceased was murdered) were tested by the learned Magistrate in details against the evidences produced in court and his conclusion that the allegations were baseless cannot be faulted. Hence the open verdict was the only option available to the learned Magistrate.

Finally in respect of the request for a court direction to the police to conduct further investigation, such request in my view is not within the purview of the court and hence I decline the request.

For reasons stated above, I dismiss this application.

High Court rejects bid to revise coroner's verdict in Rumie's death

According to reports, Rumie fell to his death from the ninth floor of a building housing the department's office in Pending here on Sept 17, 2004.

Present in court were Rumie's family members, including his widow Suraidi Abdullazid, sons Syafi, nine, and Hafeez, six, who were clearly disappointed with today's ruling.

In view of the High Court ruling, he urged the public prosecutor to review the findings of the lower court, presided over by coroner Tengku Sharizan Tuan Lah.
